Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced Case Management inspection due to an incident that occurred on 2/7/23 and was reported to the Department on 2/9/23. A COVID risk assessment was conducted, and LPA wore appropriate personal protective equipment. LPA met with Lead Teacher, Cecilia Castillo to whom the reason for the visit was explained. Ms. Castillo guided LPA on a tour of the facility. Census was taken. There were 3 staff present caring for 12 children. The facility was observed to be operating within the license capacity limitations. Education Coordinator, Yadira Lugo, arrived on site during the visit.

On 2/9/23, an unusual incident report was made to the Department regarding an incident that involved a child who stated Staff #1 makes her run and jump when child does not want to. LPA interviewed 5 staff and 2 children on this day. No disclosures were made during interviews regarding any staff instructing a child to run or jump when they do not want to do so. Children interviewed stated if they do not want to exercise, they can sit down and do not have to participate. Staff deny any knowledge of a child being forced to run or jump. Executive Director, Latonda Williams stated “an internal investigation revealed (complainant’s) story changed several times and it was determined not to be accurate and there was no disciplinary action taken against staff #1”.

Based on information obtained during this investigation, no additional follow up is necessary at this time regarding the incident reported. The facility followed all proper procedures regarding self-reporting the allegation.

No deficiencies are being cited at this time. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
