Licensing Program Analyst (LPA) Judy Mora conducted an unannounced inspection to conclude the investigation for the above allegation. There was no staff available to guide LPA on a tour. Director Michelle Johnson was not available during this inspection. LPA later met with Teacher Elvira Valencia.

During the course of this inspection LPA visually observed the infants and staff in the classroom to determine if needs of children and ratios are being met. LPA inspected the facililty both indoors and outdoors. LPA also obtained a copy of the facility roster. Furthermore, LPA obtained copies of staff sign in and out sheets and children's sign in and out sheets for the weeks of 08/02/21, 07/12/21 & 07/05/21. Based on the available information, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 6), are being cited on the attached LIC 9099D.

Licensing Program Analyst (LPA) Judy Mora conducted an unannounced inspection to conclude the investigation for the above allegation. There was no staff available to guide LPA on a tour. Director Michelle Johnson was not available during this inspection. LPA later met with Teacher Elvira Valencia.

During the course of this inspection LPA visually observed the infants and staff in the classroom to determine if needs of children and ratios are being met. LPA inspected the facililty both indoors and outdoors. LPA also obtained a copy of the facility roster. Staff interviews were also conducted.
Although the allegation may have happened or is valid there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated. No disclosures were made in regards to the above allegation.
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview conducted with Elvira Valencia. Appeal Rights explained and provided.

Sign in and out sheets show that on 08/03/21, there were 5 infants present with 01 staff before 7:30 AM. In addition, disclosures were made in regards to there not always being a staff person physically in the infant nap room at all times due to there not being enough staff. These pose an immediate Health and Safety risk to clients in care.

Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

Exit interview was conducted with Elvira Valencia. Appeal rights and procedures were explained.

Staff-Infant Ratio
There shall be a ratio of one teacher for every four infants in attendance.
This requirement was not met as evidenced by Sign in and out sheets show that on 08/03/21, there were 5 infants present with 01 staff before 7:30 AM. This is an immediate risk to the health and safety of children in care.
