Licensing Program Analyst (LPA) Fabiola Vasquez contacted the facility on 11/04/20 via telephone due to COVID-19 and precautionary measures. LPA spoke with Martha Vazquez, Licensee. LPA stated the purpose of the contact is to provide the findings for the above allegations.

Census: 3 Staff: 1

Pertaining to the allegation that, Licensee leaves daycare children unattended while in care, during the interviews conducted with children, parents, and staff there were no disclosures made that children are left unattended while in care. Disclosures were made that Licensee is cooking or taking calls and when she is finished, she comes back. Licensee is in the facility.

This agency has investigated the complaint alleging there was a violation of Title 22, Division 12, Chapter 1 Article 06, Section 102417 (a) Operation of a Family Child Care Home. The complaint alleged that Licensee leaves day-care children unattended while in care. Based upon the interviews and documentation as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

Pertaining to the allegation that, Day-care children are not allowed to use the restroom, during the interviews conducted with children, parents, and staff there were no disclosures made that limited or prohibited children from using the restroom. Disclosures were made that children use the restroom one at a time and children have not had any wet accidents.

This agency has investigated the complaint alleging there was a violation of Title 22, Division 12 Chapter 1


Article 06, Section 101223(a)(4) Personal rights. The complaint alleged that Day-care children are not allowed to use the restroom. Based upon the interviews and documentation as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No citations are being issued for the allegations listed above.

An exit phone interview was conducted with Martha Vazquez, Licensee. Appeal Rights were verbally explained. A copy of this report has been signed by LPA Vasquez. This report along with Appeal Rights (LIC 9058) will be via e-mailed to Licensee, who understands that an electronic “Read Receipt” and/or confirmation of receipt of the e-mail confirms receipt of the report and constitutes an electronic signature.
