Licensing Program Analyst (LPA) Mireya García contacted the facility on January 08, 2021 via telephone due to COVID-19 and precautionary measures in order to provide the findings of the Complaint investigation. This inspection was conducted with Director, Rahini Sabanayagam, via a tele-inspection by use of Facetime. During this tele-inspection the Director took this LPA on a tour of the facility. There were 9 children present at the facility during this tele-inspection.

Information provided by the complainant alleges that the staff hit day care child, staff interacted with child in a physically inappropriate manner and staff made inappropriate comments to day care child.
During this investigation, LPA García obtained; copies of LIC 9040 Children’s roster dated 10/15/2020, Classroom Roster dated 03/09/2020, LIC 500 Personnel Report dated 01/01/2020 & 10/15/2020 and conducted interviews with four (4) day care children, three (3) Staff, Director, two (2) parents of former children who attended facility, two (2) parents of currently enrolled children who attend facility and attempted to interview child in question. Pertaining to the allegation of staff hit day care child, all interviews conducted with staff determined staff denied observing or having knowledge of any child being hit while in care. In addition, all staff denied having knowledge of any issues with any child in care. All four (4) children interviewed made no disclosures. All four (4) families interviewed denied their child being hit or staff hitting.

Regarding to the allegation of Staff interacted with child in a physically inappropriate manner, all interviews conducted with staff determined staff denied observing or having knowledge of any staff interacting with any child in a physically inappropriate manner. In addition, all staff disclosed that in relation to the discipline of children, children sit next to staff in question while the staff talks to children. Three (3) children interviewed statements concur regarding the discipline of children by staff in question who talks to children while children sit. One (1) child made no disclosures. All four (4) families interviewed disclosed in the time attending day care all families have not had any issues or concerns with staff or day care services.

Referring to the allegation of Staff made inappropriate comments to day care child, all interviews conducted with staff determined staff denied observing or having knowledge of any staff making inappropriate comments to day care child. All four (4) children interviewed made no disclosures. All four (4) families interviewed denied any staff making inappropriate comments to day care child. Based on the interviews conducted, at this time there is not enough evidence to support the above allegations.

This agency has investigated the complaint alleging staff hit day care child, staff interacted with child in a physically inappropriate manner and staff made inappropriate comments to day care child. Although the allegations may have happened or are valid; Based on interviews conducted; there were no witnesses to the allegations and the child in question was not able to be located for interview, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the allegations are deemed Unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

A Notice of Site Visit was not provided to Director, Rahini Sabanayagam since a physical inspection was not conducted.

Exit interview was conducted with Director, Rahini Sabanayagam via tele-inspection, during which Appeal Rights were verbally explained to Director. A copy of this report has been signed by LPA García. This report, along with a copy of the Appeal Rights (LIC 9058) will be scanned via e-mail to Director Rahini, who understands that an electronic “Read Receipt” and/or confirmation of receipt of the e-mail confirms receipt of the report and constitutes an electronic signature.
