32 | The reporting party stated that although there were no direct evidence or statement from her own child regarding the allegations, her child did show signs that indicated she did not like attending the day care. During an interview, the Licensee denied the allegation and made no disclosure. Parents of children enrolled were interviewed during the investigation. The parents interviewed did not provide any information that directly corroborated the above allegation. Staff#2 and Staff#4 were interviewed during the investigation. The Staff members interviewed did not provide any information that supported the above allegations. LPA attempted to interview Child#1 during the investigation but no avail. Child#1's parent was interviewed via phone by LPA Lee.
The complaint alleged that the licensee forced children to eat food and put children in time out in the restroom. The reporting party was provided with these details by Staff#3 who no longer works at the facility and was unable to be reached for an interview. Parents of current children enrolled, and current staff members available were interviewed. The Licensee stated that on the rare occasion a child was put in time out in the past, he or she was never placed in the restroom with the doors closed. The Licensee also stated that children are never forced to eat at the day care, but only encouraged to eat their food verbally.
Based on the evidence collected during the investigation, the allegations that the Licensee force fed a day care child and used an inappropriate form of discipline on a day care child may be valid. However, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegations are found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain this posting for 30 days will result in a civil penalty of $100.00 dollars. |
