Licensing Program Analyst (LPA) Elka Chavez conducted an unannounced annual required inspection to the above facility on 05/25/2022 in Spanish. LPA arrived at the facility at 11:45 AM and met with Martha Villalobos, Licensee who guided analyst on a tour of the facility. Entrance Checklist for Family Child Care Homes was provided to the licensee upon entry. There was 1 child present upon arrival.

This is a two-story home which consists of 6 bedrooms, 4 bathrooms, kitchen, dining room, living room, attached garage, pool house and backyard (fenced). Day care is provided in the first bedroom adjacent to the living room. Licensee calls it the playroom. The children use the bathroom in the playroom, living room, dining room and backyard (fenced). Per licensee, areas off limits to children and parents include: 5 bedrooms, licensee's bathroom, pool house and attached garage. All off-limit areas need to be made inaccessible to children in care. The licensee understands that licensing staff may have access to off-limit areas during inspection visit if necessary. Food is provided by Licensee. Licensee was reminded if children bring food from home it must be labeled with the child’s name and properly stored or refrigerated.

Individuals residing in the home have been discussed and noted. All adults present in the home have obtained a criminal record clearance or exemption. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection:

At 12:10 PM LPA reviewed required posted documentation for Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. Facility records were reviewed for LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan and Disaster drill log, last drill conducted on 04/11/22.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Licensee stated that she will inform licensing of any construction, repairs to the home within 24 hours. Licensee stated that she is taking the children to Brookshire Park for outdoor play. Once repairs are complete she will call licensing or LPA.

Smoke and carbon monoxide detectors were tested. LPA did not hear the test alarm to sound go off. LPA observed licensee change the batteries and LPA heard test alarm sound turn on. Fire extinguisher indicated fully charged and was serviced on 4/11/22 as indicated on the service tag. The home maintains telephone service via cell phone. The home is observed to be clean and orderly. There are toys and other age appropriate material available for children. LPA observed stairs are screened to prevent access by children with a child safety gate. LPA observed detergents on top of the front-loading washer. LPA observed licensee remove the detergent and placed inside a top cabinet with a child safety latch. Licensee understands that all poisons must be locked. Isolation area for sick children waiting to be picked up is in the living room, away from the other children. Per Licensee there are no firearms or weapons stored in the home. LPA observed that licensee is implementing COVID-19 precautions and procedures.

Currently Licensee is not caring for any infants. LPA informed Licensee of the new Safe sleep regulations, including LIC 9227 Infant Sleep Plan for infants under 12 months, and the 15-minute sleep check documentation for infants 0-24 months.

At 11:50 AM LPA observed the pool is under construction. LPA observed the mesh fence had been partially removed. Licensee stated that it was due to repairs of the pool. LPA observed the pool is inaccessible to children. LPA observed the door leading to the backyard to be kept locked. Per licensee they are plastering the pool. They job started 4 days ago and should be done no later than July 02, 2022. Licensee stated that the backyard is not being used during the construction. The children are going to Brookshire Park for outdoor play. LPA observed a dog (basset hound) is kept inside the garage when children are in the backyard (fenced).

At 12:55 PM LPA observed the licensee completed training on preventive health practices including Adult and Pediatric First Aid and CPR on 9/29/20 from CPR Certified Indigo Medical Training. LPA did not observe EMSA stickers. The licensee has proof of immunization against measles, pertussis and influenza, TB clearance, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate. There are first aid supplies available. LPA observed them in the top kitchen cabinet.

Children’s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment and LIC 995A Notification of Parents’ Rights.

Licensee, Martha Villalobos was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee, Martha Villalobos and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee Martha Villalobos of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Based on the LPA’s observations and records review, the following deficiencies listed on the attached LIC 809 (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.
