Licensing Program Analyst (LPA) Judy Mora conducted an unannounced Annual/random inspection. LPA met with licensee, Abigail Manhey, who guided analyst on a tour of the facility. The licensee's assistants, Sylvia Castillo and Maria Iturvide were also present.

The Licensee had 2 other staff present that do not have a Criminal Record Clearance on file. Marietta Hurt who does story time with children once every Thursday. LPA observed that she was alone with children in the garage/activity space area. The other employee, Art Teacher, Linda Joe, who comes to the facility twice a week for the past 3 years. Ms. Joe was able to provide a copy of clearance, however, she is not associated to the facility. The individuals are paid employees and not volunteers. Civil Penalties are being assessed.

LPA observed 14 children present with the Story Time staff member. Licensee states that there are currently 17 children enrolled, children's roster was reviewed and is current. Disaster drill log was available, last drill documented was 09/15/19.

During children's files review and review of roster, LPA observed that the 14 children present consist of 3 infants and 11 children ages 2 through under 5 years of age. There is no school age child present nor a child who is at least 6 years of age. This places the Licensee out of ratio for a Large Family Child Care Home.

This is a one story home which consists of 3 bedrooms, 2 bathrooms, kitchen, dining room, living room, attached enclosed patio (activity space), detached garage (activity space), front and backyard (fenced). The children have access to 2 bedrooms, 2 bathrooms, living room, kitchen, garage, enclosed patio, front and back yards. Per licensee, areas off limits to children and parents include: 1 bedroom. The LPA toured all areas used by children during this visit.

Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

Licensee was advised that fees are not current. LPA provided balance and pin # print out from LIS

LPA advised the licensee how to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

The deficiencies listed on the following pages were observed by the LPA and are being cited in accordance with California Code of Regulations Title 22 and/or the Health and Safety Code. Please see attached LIC 809d. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

Exit interview was conducted with Licensee's Assistant, Maria Iturvide. The Licensee had to leave to pick up her child from school when LPA was ready to review report. The Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms.

Areas accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating (central air) for safety and comfort. There is a fire place in the living room which is inaccessible. There is a working telephone service maintained in the home. Family members residing in the home are 2 adults (criminal record clearances on file) and 2 children. There are 5 chickens kept in a chicken coup in the backyard.

Detergents, cleaning compounds, medications, and other items which can pose a danger to children are accessible in the kitchen under the sink and in another cabinet. The Licensee has latches available in the home, however, there are not any on these cabinets. Per licensee, there are no poisons in the home. The licensee does understand that poison must be locked with a key or combination lock. Per licensee, there are no weapons, firearms or bodies of water on the premises.

There were safe toys, play equipment and materials observed for children. Emergency Disaster Plan was observed to be posted at the time of visit. LPA requested that a new LIC 610 Emergency Disaster Plan be submitted to the Department to update Temporary Relocation Sites. Children’s records were reviewed to ensure that each child has an Identification and Emergency form. LPA observed that one child, #12 did not have a form on file. During child file review, LPA observed that not all children have immunization's on file. LPA also observed that several children do not have the LIC 9224, Acknowledgement of Receipt of Licensing Report from visit conducted on 10/17/18. The valve on the required 2A 10BC fire extinguisher indicates fully charged (serviced 03/30/19). Smoke detector and carbon monoxide detector in the bedrooms and hallway were tested, and are in operable condition. The Licensee and licensee's assistant, Maria Iturvide, have current Pediatric First Aid and CPR, which will expire 11/2020.

Incidental Medical Services (IMS) policy was discussed. Per Licensee, there are no children on medication. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. SB792 (Immunization Requirements for Staff and Employees) was discussed with the Licensee. The Licensee only has assistant, Maria Iturvide's immunization's on file. Licensee was unable to provide immunization's for Sylvia Castillo.

The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Sudden Infant Death Syndrome (SIDS) and Never-Shake-a-Baby were discussed.

LPA provided Safe Sleep Concepts.

LPA provided a copies of the following Title 22 Regulation Sections:

102370 Criminal Record Clearance, 1697.465 Large Family Day Care Homes, and 1596.8595 Posting licensing reports and reports to be provided to parents.

The following was discussed: Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain a criminal record background check clearances prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty.

No smoking, No infant walkers, No Johnny jumpers, No saucer chairs, No trampolines and any other item that falls into that category are not permitted in the facility. Effective January 1, 2010, licensees of family child care homes are required to ensure that at least one staff member with current training in pediatric first aid and pediatric CPR is on site at all times when children are present.

LPA reviewed and issued the LIC 311 - Forms/Records to Keep in Your Family Child Care Home.
CHILDREN’S FORMS/RECORDS, FACILITY FORMS/RECORDS and INFORMATION TO BE POSTED, Disaster drills, posting requirements, children records requirements, mandated child abuse and injury/ death reporting, criminal record transfer requirements, criminal record and child abuse clearances were also discussed during this visit.
