 | While in the restroom the Licensee heard some sort of noise that sounded like a bump on the floor. When she came out of the restroom, the Licensee observed that Child#1 was no longer inside their crib and was sitting on a small couch by the front door. The child was not crying or showing signs of being injured according to the Licensee. The Licensee stated they informed the Parent of Child#1 about this incident but did not check Child#1 for any injuries before the child was picked up by the parent. Child#1's last day at the family child care home was 02/26/2024 per Licensee. 
 While it is possible that Child#1's injuries could have been prevented, a child in care sustaining an injury while in care does not automatically mean that there was a lack of adequate supervision being provided by the Licensee. The Licensee stated that she placed Child#1 into a crib to quickly use the restroom. LPA Lee observed that the restroom that the Licensee used shares a wall with the crib Child#1 was placed in. The Licensee stated she was able to hear a noise while in the restroom, and after coming out the restroom observed Child#1 no longer being inside the crib and instead sitting on the couch around 10 feet away from the crib. Both the crib and couch were observed to be in the living room of the facility. While visual supervision was not being provided, the Licensee was able to determine what had happened based on the noise she heard while briefly in the restroom.
 
 During the inspection conducted on this date, LPA observed a total of 6 children with 4 of them being infants. Licensee's mother and adult daughter were present during the inspection. The Licensee was advised she cannot watch 4 infants and 2 preschool age children unless either or both family members are present at the family child care home.  Licensee stated that 3 infants and 2 preschool children present on 02/26/2024.
 
 Based on the evidence collected during the investigation, the allegations that child sustained injuries due to lack of supervision may be valid. However, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the above allegation is found to be unsubstantiated.
 
 The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting during business hours will result in a civil penalty of $100.00 dollars.
