At 1:30 pm Licensing Program Analyst’s (LPA’s) Lilli Babcock and Roxana Lopez conducted an unannounced required 1-year inspection to the above facility. A risk assessment was conducted upon entry and appropriate PPE was used. LPAs met with Licensee, Maria Morales, who guided analysts on a tour of the facility. Per Licensee, there are 12 children currently enrolled. A current children’s roster was available for review. There were 2 children present upon arrival.

The licensee states that 5 adults and 1 child currently live in the home. Per Licensee, they currently have 1 assistant. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing, or volunteering in the licensed childcare home.

This is a one-story home which consists of 4 bedrooms, 2 restrooms, living room, playroom, dining room, kitchen with a utility room, and backyard which includes 2 duplex apartments. The children have access to playroom, kitchen, dining room, one bathroom, and front yard. Living room is accessible only in passing.

Per licensee, areas off limits to children and parents include 4 bedrooms, 1 bathroom, living room, utility room, and backyard. LPAs toured all areas used by children during this visit.

All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. At 1:43 pm, LPAs observed cleaning products under the sink were accessible as there were no cabinet doors on the cabinets. Licensee states they were removed as cabinets are being painted. Licensee removed cleaners under sink during inspection. At 1:47 pm, LPAs observed the required 2A10BC fire extinguisher and service tag shows it was last serviced on 3/31/22. At 1:52 pm LPAs observed a working carbon monoxide detector. At 1:56 LPAs observed the facility smoke detector did not have batteries. Licensee put batteries in smoke detector during visit. During the tour, LPAs observed 3 bedrooms that are supposed to be inaccessible to children, were found by LPAs to be closed but unlocked. Licensee locked the doors during the inspection.

There is telephone service via cellphone and landline. There is ventilation and heating.


Medications were observed to be inaccessible to children. Per Licensee there are no poisons in the home. LPA advised that any poisons should be locked under key. The restroom that children use was observed to be safe and sanitary. Licensee states that there are no firearms stored in the home.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted 12/2021.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the entry way of the home.

LPAs observed age appropriate toys available for children.

LPA also informed licensee Maria Morales of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Currently, children are using the front yard for outdoor play time. The outdoor play area was observed to be fenced, however at 2:00 pm, LPAs observed a rosebush in the front yard where children play during outdoor time.
This poses a risk to children in care. LPAs observed that the outdoor yard has toys and other materials for children to play with.

There is 1 dog on the premises. Per licensee, the dog is kept outside in off limits areas during daycare hours.

The licensee is observed to be operating within the license capacity limitations.

At 2:07 pm children’s records were reviewed, including emergency information, and were observed to be missing immunizations records for 8 of 12 children’s files reviewed.

At 2:40 pm Licensee and staff records were reviewed and LPAs observed that
Licensee and staff #2 have not completed Mandated Reporter Training and do not have proof of immunizations. Staff #2 is also missing CPR/First Aid.


The licensee has completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 2/4/24.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on the LPAs observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
