Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Licensee Veronica Jimenez.

During the investigation, LPA Lee conducted interviews, reviewed records, and made observations in regards to the above allegations.

The complaint alleges that a staff member and the Licensee violated the personal rights of children in care by using improper forms of discipline such as hitting or pulling of the hair. The Licensee denied the allegation. Staff members interviewed during the investigation did not provide any information that corroborated the allegations. The children in care that were interviewed did not provide any information that corroborated the allegations. According to the complaint, Child#6 witnessed a staff member pull another child's hair. The name of the staff member or the child were not provided. The complaint also stated that Child#6 heard from other children that the Licensee had hit them. The names of these other children were not disclosed by Child#6.

Child#6 did describe the staff member that pulled the other child's hair having blonde hair. The staff members that work at this facility that have or had blonde hair were all interviewed during this investigation. All staff members that matched the deception denied the allegation and made no disclosure.

It is possible that the Licensee and the unidentified staff member did violate the personal rights of children in care like the complaint alleges. However it is also possible that these violations did not occur based on information obtained during the investigation.

Based on the evidence collected during the investigation, the allegations that staff inappropriately pulled day care child's hair and Licensee hits day care children while in care may be valid. However, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegations are found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain this posting for 30 days will result in a civil penalty of $100.00 dollars.
