Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with DIrector Elizabeth Kim.

During the investigation, LPA Lee conducted interviews, reviewed records, and made observations in regards to the above allegations.

The complaint alleges that Staff#6 of the facility hits children in care and uses inappropraite discipline on the children. The reporting party stated that children were hit on the buttoks with a ruler and had to stand in the corner with their hands up for several minutes. The specific child in the complaint was interviewed. During the interview, the child disclosed that he or she believed that the children would be spanked or diciplined with a ruler if they did not behave, but did not state that this form of dicipline had actually happened to him or her or saw it happen to other children. The child did indicate that he or she felt scared because of this belief during his or her time atteinding the facility. The child did mention staff#6 specificly during the interview.

The Director denied the allegations and made no disclosure. Staff members of the facility interviewed denied the allegations and made no disclosure as well.

Interviews with other individuals related to the facility was made during the investigation. There was no disclosure provided that directly supported the above allegations.

Children attending the facility were interviewed. During the investigation it was disclosed that staff#6 taught a particular class at the facility on a part time basis. This was also verified from interviews with staff members. Children in that particular class were interviewed. The children did not mention staff#6 by name when asked to name all the staff members that teach and have taught them at their class. The interviewed children did not provide any information that would indicated any type of inappropriate discipline practiced on them or seeing it used on any other children at the facility.

The complainant provided numerous recollections of inappropriate behavior from the facility. The information was mostly centered around staff#6. During file review LPA Lee observed that staff#6 had the qualifying units of a teacher. Although the allegations made by the complainant may or may not be true, there was no indication that the facility had violated any regulations in regards staff#6 and his or her qualifications to be at the facility in any capacity.

This department has investigated the allegation that an adult at facility is hitting the children in care and adult at facility inappropriately discipline children in care. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated at this time.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain notice during business hours will result in a civil penalty of $100.00 dollars.
