At 2:15 pm Licensing Program Analysts (LPAs) Lilli Babcock and Priscilla Ochoa conducted an unannounced required 1-year inspection to the above facility. A COVID risk assessment was conducted. LPAs met with Licensee, Laura Diaz, to whom the reason for the visit was explained. Per Licensee, there are 14 children currently enrolled. There were 9 children, licensee's assistant and licensee's husband present upon arrival. The licensee was observed to be operating within the license capacity limitations.

The licensee states that 5 adults and no children currently live in the home. Per Licensee, there is one assistant in the facility. All adults living in the home have obtained a criminal record clearance.

This is a one-story home which consists of 3 bedrooms, 3 bathrooms, living room, family room, daycare room/dining room, kitchen, detached garage, front yard, and backyard which is fenced.

Per licensee, areas off-limits to children and parents include 3 bedrooms, 2 bathrooms, family room, detached garage, backyard pool, and front yard. The children have access to living room, kitchen, daycare/dining room, one bathroom, and backyard (excluding pool area) which is fenced.

Licensee guided analysts on a tour of the facility. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed.

Facility License, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. A current children’s roster was available for review.

There is telephone service via a cellphone that stays at the facility during operation hours. Hours of operation are Monday – Friday, 6:45am – 5:30 pm. There is central air and heating in the home. LPAs observed a fireplace in the living room that is screened and tied making it inaccessible to children.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Poisons are locked in the off-limits garage. LPAs advised that any poisons should be locked under key or combination lock. Licensee states that there are no firearms or weapons stored in the home.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 5/30/24, as indicated on service tag. Smoke and carbon monoxide detectors were tested and were operable on this day. Licensee states she is not currently caring for infants at this time.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 7/2/24. There are first aid supplies available. There are age-appropriate toys available for children. Appropriate sleeping arrangements in form of mats were observed.

At 2:40 pm, LPAs observed the kitchen sink was full of dirty dishes and dirty pans, the stove top had multiple remnants of dried food on it along with a dirty pan on top of the stove. LPAs also observed the stove top control panel at the top of the stove to be coated in grease, and the baseboard in the kitchen was apart from the wall and laying on the floor. Additionally, LPAs observed the inside of the toilet bowl in the children's bathroom to have a black ring in the toilet bowl. Also, LPAs observed cob webs in the corner of the living room.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did observe a swimming pool in the backyard which meets Title 22 Requirements.

Children’s records were reviewed, including emergency information and were observed to be complete.

Licensee and staff records were reviewed. The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 4/19/25 and card contains the red and green EMSA stickers indicating it is from an approved EMSA training company. Mandated Reporter Training for the licensee expires on 6/5/25.

LPA issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

There are 3 dogs and1 cat on the premises. Per licensee, the dogs are kept outside in off-limits areas, and the cat is kept in an off-limits bedroom during daycare hours.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family child care facility.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a
criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee, Laura Diaz, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Based on LPA's observations and record reviews, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22.


Deficiencies that are being cited need to be cleared to protect the children's health and safety.


A notice of site visit was given and must remain posted for 30 days.
