Interviews were also conducted with staff (5), children (8) and parents/guardians (8). Per parent #1-#7 interviews, no disclosures were made regarding the allegations above. Per interview with P8, parent stated that C4 stated that S4 did “pow pow” to them, however when brought to facilities attention the incident was denied and P8 stated to move forward with the facility, as P8 clarified incident with the facility. Per child interviews, no disclosures were made regarding the above allegations. No disclosures were made during interviews to corroborate the alleged allegations.
Based on the evidence obtained during the course of the investigation through child interviews, staff interviews, parent interviews, observations and record review the evidence does not support, nor disprove the above allegations of staff hits day care child in care resulting in bruising and staff leaves day care child soiled. The above allegations are Unsubstantiated. There is not enough evidence or witnesses to substantiate, therefore, allegations are rendered Unsubstantiated at this time. A finding that the complaint is unsubstantiated means that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged allegations occurred. At this time LPA is unable to make a determination that any violations occurred.
An exit interview was conducted with Director Sister Veronica Sanchez and a copy of this report, Notice of Site visit and Appeal rights were provided on this day.
