On 05/30/2025 at 2:20 pm, Licensing Program Analyst (LPA), Carolyn Tuba conducted an unannounced annual inspection for the above facility. This facility is a Large Family Childcare Home. LPA met with Assistant, Rosario Gonzalez. Licensee was out picking up additional children and arrived shortly after and guided LPA on a tour and there was a census of 7 children in care with was also an additional adult present who also. According to Licensee 19 children are currently enrolled on various schedules.

During the course of the visit LPA observed a facility roster was available. Per Licensee, operating hours are Sunday - Saturday 5:30 am – 7:00 pm and per Licensee she also provides overnight care, Sunday-Saturday 8:30 pm – 5:30 am. Licensee reports that she uses monitors and stays close by and awake while the children are sleeping. Per Licensee the age group she currently works with are Birth - 13 years old. The licensee is not part of a food program but provides all meals including breakfast, AM snack, lunch, PM snack and dinner to the children in care.

This is a one-story house which consists of a living room, family room (play area), 3 bedrooms, kitchen, breakfast nook, garage, front yard, back yard, side yard, and 1 bathroom.

Child Care areas were inspected and used by the children as follows: the living room, family room (play area), one bedroom (play area), bathroom, and backyard. A sofa in the family room is utilized for an ill child. Per Licensee, areas off limits to children include 2 bedrooms, kitchen, front yard, side yard and garage.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Licensee is utilizing a baby gate to separate the kitchen and child proof doorknobs for the bedrooms. LPA also observed inside the bathtub in the bathroom that children use had soaps and shampoos inside the bathtub. LPA advised the Licensee that those should be locked up or placed in an area out of reach for children in care. (Technical Violation Advisory issued)

The licensee states that 2 adults including herself currently live in the home and no minor children. Per Licensee, her daughter also assists with the care of the children. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing, or volunteering in the licensed childcare home.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The home was inspected for safety, comfort, cleanliness, ventilation, and telephone service.
Fire and safety drills must be performed every 6 months and documented for review by the Department. Licensee conducted an Emergency Drill in May 2025. No one smokes in the at family childcare home.

In the absence of the licensee a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current Pediatric First Aid and CPR training, Immunization's (TDAP, MMR, TB, Influenza), mandated reporter training and a valid criminal record clearance associated to the facility license.

The licensee and assistants provided proof of the Mandated Reporter Training certificates that expires, October 2025. LPA advised that Mandated Reporting training needs to be conducted every 2 years. The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee, and her assistants currently have Pediatric First Aid and CPR which expires on 9/2025, including EMSA approved sticker.

Detergents, cleaning compounds, medications, and other items, which could pose a danger, were determined to be inaccessible to children in care during this inspection and are kept locked under the kitchen sink with a child-proof lock. Medication is kept in the off-limit area of the bedrooms.

LPA observed the required 2:A-10:B-C fire extinguisher and tag stated the last time it was inspected on September 7, 2023 past due the annual service. LPA advised that per State Fire Marshall standards, fire extinguishers shall be service annually. The smoke detector and carbon monoxide detector were tested and operating correctly. Per Licensee, there are no weapons, firearms, or bodies of water on the premises. Per Licensee there is one small Chihuahua dog who was friendly. He is kept in a dog run outside in the backyard or in the bedroom during warmer months.

LPA advised the Licensee with regards to safe sleep and that infants under 24 months shall be checked on every 15 minutes and the time of each 15-minute check shall be documented with child’s name, date and initials of the person who checked on the child. LPA provided Licensee a booklet on Safe Sleep in Spanish. The LIC 9227 Individual Infant Sleeping Plan shall be completed for each infant up to 12 months of age. LPA advised Licensee the Provider Information Notice (PIN) 20-24 CCP: Recently Approved Safe Sleep Regulations in Effect. Per Licensee she checks infants and documents the 15-minute check.

The licensee is observed to be operating within the license capacity limitations. LPA did not observe any children left in parked vehicles. Car seats shall only be used for transportation. LPA did not observe any children sleeping in car seats. The Licensee was reminded to utilize play yards, cribs, and highchairs for what they are intended for and not leave children in them for any other reason.

At 2:25pm LPA observed a child in the play yard with blankets and bottle of milk who had just awaken from a nap according to the assistant. LPA consulted with both Licensee and the assistants that no loose articles she be inside of the play yard or crib. The infant child should be napping only on a fitted sheet with no blankets, toys, or loose articles inside or hanging from the crib or play yard. Safe Sleep documentation provided in Spanish and in English to review.

Per Licensee the children have not been utilizing the back yard for outdoor play time due to the licensee is cleaning the area but plans on being done by next week. The LPA was still able to inspect the outdoor play area and observed that it was enclosed with a concrete wall and measuring at least 6 feet high. LPA observed that the outdoor yard has toys, bikes, play equipment (wood chips to cushion falls) and plastic cars, as well as other materials for children to play with.

Children and Staff records must be maintained and updated as needed and must be available for review by the Department. LPA found that the files were complete and documented children’s names and staff names. LPA advised that the 15-minute log and Individual Infant Sleep Plan needs to be in the infant file for record keeping. If Children and Staff leave the day care all records must be maintained for 3 years after leaving.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

According to Licensee there are currently no children taking medications. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

The deficiency listed on the following page were observed by the LPA and is being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809-D. The deficiency that is being cited needs to be cleared to protect the children’s health & safety.

LPA, Carolyn Tuba informed Licensee, Carina Snachez this report dated 5/30/2025 document(s) (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety or personal rights of a children in care. Also, LPA, Carolyn Tuba informed Licensee, to provide a copy of this licensing report dated 5/30/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or written statement, must be placed in the child’s file for verification.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Licensee, Carina Sanchez.
