Licensing Program Analyst (LPA) Mireya García arrived unannounced at the facility for the purpose of conducting a follow up complaint investigation to deliver findings regarding the allegations listed above. Due to COVID-19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA met with Office Manager, Danielle Harris who guided LPA on a tour of the facility. There were 57 children observed to be present at the facility during this inspection.

Complaint alleges that children are not wearing masks and that staff and children, including the Principal were sick on 01/03/22 (testing day). Complaint alleges that staff and children present on this day were not asked to go home and were not required to quarantine once positive COVID cases were confirmed. Complainant also expressed concern about shared restrooms.

During this investigation LPA M. García conducted interviews with staff, parents, and children. LPA Garcia also obtained several documents related to complaint allegation, including but not limited to, copy of Children’s roster dated 01/06/2022, children’s sign in sheets for the week of 01/03/22-01/07/22 and parent letter (English/Spanish) regarding confirmed positive COVID-19 case dated January 3rd, 2022. LPA also obtained COVID related documents, including but limited to testing, positive cases, and exposure protocol.

Pertaining to the allegation that children are not wearing masks, interviews with day care staff and day care parents reveal all staff and day care parents deny observing or having any knowledge of children not wearing masks. Day care children interviewed made no disclosures.

LPA observed children wearing masks during inspections conducted on 01/06/22, 03/04/22 and 03/25/22. In addition, LPA observed personal protective equipment; disposable protective mask (kids/adult size), hand sanitizer, thermometer, disinfectant spray. Masks were observed in quantities to meet the needs of children in care.

LPA conducted interviews with staff regarding allegation that staff and children tested positive and those exposed were not put on quarantined. LPA also obtained supporting documentation that confirmed positive cases, dates individuals were present at the facility and verification of classrooms closed due to staff and children quarantine.

Interviews conducted disclosed that upon returning from winter break all children and staff were tested (Antigen and PCR) at the facility. Interviews further disclosed that individuals who received a positive PCR test result (after receiving a negative Antigen test result) or were exposed to an individual who tested positive, were asked to quarantine.

Interviews confirmed that parents waited at the facility. Children who tested positive were immediately sent home.

LPA reviewed COVID related documents that confirm positive cases and quarantine dates for staff and children. LPA also confirmed that five classrooms were closed. Report continues on next page 3 of 4.

Based on the interviews conducted and records review, at this time there is not enough evidence to support the above allegations. This agency has investigated the complaint alleging that children are not wearing masks and staff and children tested positive and those exposed were not put on quarantined by facility. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are deemed unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with Licensee representatives, Salvador Sandoval and Danielle Harris.
