Licensing Program Analysts (LPA) Cynthia Reyes conducted an unannounced site inspection to investigate the complaint allegations listed above. Upon arrival licensing staff met with Assistant Director, Katherine Bergiman, who took LPA on a tour of the facility. Supervisor Heather Jenkins arrived shortly after. No school age children are present at this time.

The allegation states that the Facility’s transportation vehicles are in disrepair, as well as the school age component. Reporting Party (RP) alleges that the bus/vans tags have expiered, they have broken mirrows, the air conditioning does not work and they are dirty. RP also reported that in the school age playground area there are nails coming out of the turf that could hurt a child.

LPA conducted interviews and observations of the school age component. LPA observed that the 3 van/bus have expiered tags dated September 2022. The white van with the logo also has a broken seat belt. Per interviews and observation the vans have been cleaned and detailed.

Per interviews and observation the vans have been cleaned and detailed (Text messages from detailer was shown). The Blue van/bus has a broken side mirror to see the rear of the vehicle.

As for the school age outdoor play yard, LPA observed during the walk through with the Assistant Director Katherine, the black tarp below the wood chips is protruding in several areas of the yard and LPA also observed nails protruding from the green fake grass area, and the wood surrounding it is warping. LPA observed the yard to have trash and the trash can is over flowing and it was stated that the yard has not been cleaned for a week now. Per interviews it was stated that the owner has been aware of the nails since July/August and that the children were told not to use the green fake grass area because of the nails. It was also stated that yellow caution tape was around it, however LPA did not observe any at this time. LPA also observed the door leading to the outside play area from the school age class room is broken at the top that helps hold the door open.

Based on the available information and LPA observations, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter Number 1), are being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days. Exit interview was conducted with Site Supervisor, Heather Jenkins. Appeal Rights explained and provided.

Supervisor states will have the yard cleaned and fixed by the POC date. Supervisor states will submit a letter with the details of how she will have part of the yard closed while being fixed and how the ratio will be met outside by using a staggered schedule during the correction period.
