An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 08/1/2022. A risk assessment was conducted appropriate PPE was used. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 6/21/2022. LPA met with Owner Ofelia Aguilar to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, children and parents. LPA also reviewed and obtained copies of children’s rosters, personnel reports, attendance sheet, diaper logs and other documentation.

An interview was conducted with the complainant to obtain further details regarding the allegations made. Per initial complaint report, the complainant reported that Child # 1 disclosed that Staff # 1 was mad and had choked and slapped them.

In regards to allegation # 1 day care child was slapped while in care and allegation # 2 day care child was choked while in care: LPA conducted interviews with complainant, victim, children and staff. Though complainant mentioned that child # 1 disclosed that Staff # 1 had slapped them and choked them, no disclosure was made by child. Child # 1 disclosed that they like their teachers, that teachers are nice and have not hurt them.

LPA conducted interviews with staff # 1- 6. All staff statements corroborated that they have not slapped or choked a child and have not witnessed any staff hurt a child. Staff # 1-6 corroborated that if children are having a hard time they talk to the child, they go down to the children’s level to talk about the situation and work out a plan. Staff also corroborated they have a quiet area with different activities children can use. Staff # 1-6 corroborated that diaper changes are conducted every two hours unless a child needs to be change before. Staff also corroborated that if a child has a diaper/potty accident, they change the child immediately- the dirty clothes goes into a bag to send home, sheets are wash and cots are cleaned and sanitized.

LPA conducted interviews with parents and children. Parent’s statements corroborate that they do not have any concerns with teachers and that they are happy with the care their child receives. Children’s statements corroborate that they like their teachers and that they have not been hurt by any teachers.

This agency has investigated the complaint alleging day care child was slapped while in care and day care child was choked while in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
