Licensing Program Analysts (LPAs) Nolan Tcheng and Staicy Perry conducted an unannounced random inspection. Upon arrival at 11:25pm, LPAs met with Director Hyungmi Yoo. At 11:35am, LPAs were led on a tour of the facility. This is a preschool program with a toddler option which consists of 3 classrooms, only one room was in use during time of inspection. Per licensee, there are currently 7 enrolled in the program. Hours of operation for this facility are 7am-6:30pm, Monday-Friday.

Licensing staff observed all required forms/publications to be posted in the front hall. Snack menus were reviewed to ensure that they are being posted one week in advance where it is visible by the child's authorized representative. Menus for the past 30 days are available upon request.

At 11:35am, LPAs entered and inspected Pre-K Room: 3 children with 1 staff member. Per director the 2 other classrooms are now used by the church and are not used for child care. LPA discussed the Toddler room needing to be used for toddler age children. During the tour, LPA observed 1 of 3 children to be Infant age. They were observed playing in the same room as the preschool age children. LPA instructed the Director to have the child move to the office with the Director. Child cannot being placed with in the preschool room unless enrolled and of preschool age. Disinfectants, cleaning solutions, medication and other items that are dangerous to children, were inaccessible to children. Furniture and equipment are in good condition, free of sharp, loose, or pointed parts. All floors are clean and safe. LPAs observed the napping equipment to be cots. All storage containers for solid waste, including moveable bins shall have tight-fitting covers that are kept on, and in good repair. Trash cans used to discard food have tight fitting lids. The facility was observed to be free of flies, other insects and rodents. Sufficient individual storage space for children was observed and each child has a cubby. Drinking water was readily available indoors. At this time, the office is used as an isolation area. A cot is available for an ill child to rest on. First Aid supplies are available and complete. Facility has a functioning carbon monoxide detector that meets statutory requirements. Director states there are no weapons, firearms, or bodies of water on the premises. At 11:45am, a fire extinguisher was observed. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 11/23/2021, as indicated on service tag. Per State Fire Marshall standards, fire extinguishers shall be serviced annually. LPAs discussed with director that this needs to be conducted yearly and is out dated. All food preparation areas and food storage areas are kept clean and are free of litter, rubbish and rodents and/or any other vermin. Snacks were reviewed for availability, quantity and appropriateness to children in care. This facility provides breakfast, lunch, am snack, and pm snack.

The outdoor area was observed. The previous outdoor play area is currently blocked off and no longer in use. At this time, the facility is using gated walkway for outdoor time with the children. The outdoor area was observed to be free of hazards.

Teacher-child ratios were observed to be in accordance with Title 22 regulations. Staff names were recorded. All children were observed to be under visual supervision of a teacher during tour. All areas were identified on the Facility Sketch were inspected.

Sign in and out sheets were reviewed to ensure that the person who signs the child in and out uses their full legal signature and records the time of the day. Disaster drills have not been conducted at least every six months. Per Director, they state that they have not done emergency disaster drills because of COVID. LPAs instructed the director to continue with emergency drills. Staff files were reviewed for a health screening report and immunizations that meet regulatory requirements. LPAs observed during staff review that 2 staff files did not have the immunization records present.

Criminal Record Clearance for adults and verification of CPR/First Aid and health preventative practices documentation was reviewed. The name of the child care center director or fully qualified teacher(s) designated to act in the director's absence is on file. Educational background, training, and/or experience for each staff present are on file and were reviewed. During review of educational background, LPAs observed that Staff #2 has not completed 12 semester units to be a fully qualified teacher. LPAs are providing an Advisory Note to address the need for completion of semester units. During file review, LPAs also observed that 3 of 3 staff files did not have current Pediatric CPR/First Aid training completed. Director states that they have not completed new training due to COVID Pandemic. LPAs instructed Director that it is still a requirement of staff to complete. Mandated reporter was not completed due to all staff's primary language of Korean not being available for training.

A random sample of Children’s Records were reviewed to ensure that they are complete. During review of children's files, LPAs observed that 1 of 3 children files did not have the child's record of immunizations. LPAs discussed with director the importance of keeping all immunization records in enrolled children's files.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. PIN 22-05-CCP. CCC DID NOT COMPLETE TESTING PRIOR TO THEIR DEADLINE, LPA referred Director to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

The deficiencies listed on the following pages were observed by the LPA and are being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809D for deficiencies that are being cited and need to be cleared to protect the children’s health & safety.

Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative.

Exit interview was conducted with Director Hyungmi Yoo, at _____, and Plan of Corrections were reviewed and developed. Copy of Report Provided.
