An unannounced, in-person, follow-up Complaint inspection was conducted on this date by Licensing Program Analyst (LPA) Emiko Bell. The purpose of this inspection was to provide the findings of the Complaint investigation. Upon arrival, LPA let herself into the faciity by the gate code.

Census: LPA then walked into Room 1 and took census; there was one staff with nine children. When LPA went into the hallway, LPA ran into Assistant Director Lisa Seggelke, to whom the purpose of the inspection was announced. At 08:15, census was taken in room 2: there was one staff with ten children and in room 4, there was one staff with 11 children.

Throughout the course of the investigation, interviews were conducted with four staff and four parents and documentation in the form of the Child Care Facility Roster (form LIC 9040) and two notices to parents dated 03/27/20 and 06/25/21 were provided; on 07/14/21, LPA took photos in rooms 1, 3, and 4 as well as of the break room and kitchen.

-Pertaining to the allegation that “Staff are not releasing children to parents at their request”:

According to the Reporting Party (RP), beginning in June 2021, parents have been told by the facility that they cannot come and get their children until after 04:15 pm. If a parent arrived prior to 04:15, they were allegedly told that they could not get their children and were asked to wait in their car or come back later. In addition, parents were not given advance notice that they could not pick up their children prior to 04:1,5 and when asked why they could not pick up their child prior to 04:15, no explanation was provided.

Three parents were interviewed regarding this allegation. According to Parent 1, they were told to not pick up their child at noon because it is nap time (which, for preschoolers, is scheduled 12:30-02:30), but were otherwise told they could pick up their child anytime, as long as they informed the Center in advance; and that if they didn’t call in advance, they may have to wait 10-15 minutes for staff to bring the child to the gate. According to Parents 2 and 3 (P3), though they were permitted to pick up their children early, it was a “big deal” and staff were “visibly upset” that they had arrived to pick their children up before their scheduled pick up time. When asked why it was a problem, P2 was told that it was because “other parents would see and want to pick up their children early” as well; no explanation was given to P3. When asked whether they were given advance notice as to why they could not pick up their children before their regularly-scheduled time or why not until 04:15, all three parents said no—that it seemed like a randomly-scheduled time. According to the RP, the time was chosen so that the Center could get paid a full day if the child’s tuition is subsidized through the government; as LPA does not know whether

Parents 1-3 pay tuition privately or with financial assistance, this was unable to be verified.

All four staff interviewed corroborated that parents are discouraged from picking their children up outside of their normal contract hours. When asked what the contract hours are, it was stated either half day (3.75 hours), 6 or 7 hours, and then full day (07:00 am-05:00 pm). When asked why parents are discouraged from picking children up early, Staff #1 (S1) and Staff #2 (S2) explained that it’s because in the afternoon, between 03:00-04:00 pm, staff have an extra Montessori work time session during which the children work on math and language. However, both S1 and S2 stated that parents may pick up their children early if it was an emergency (such as an appointment or car trouble) but that they ask parents to call in advance so that staff can get the child ready (e.g. take them to the restroom) before the parent arrives. According to Staff #3, it has to do with contract hours and whether or not the school can write off the hours as excused or not. Staff #4 did not know why parents cannot pick up their children early and believed the rule to have just been implemented early July 2021.

According to the notice to parents dated March 27, 2020, the Center hours changed to 07:00-05:15, with drop off time between 07:00-08:00 and pick up time for AM program at 11:30 am and for full day and private from 04:15-05:00. But that “in case of an emergency, parents may pick children up earlier than their assigned time, but the school must be informed in advance.” The children of P2 and P3 were enrolled almost a year after the notice was given and documentation could not be provided that the parents of children enrolled after March 27, 2020 received a copy of this notice; per S1, they are informed verbally during orientation.

The notice states that parents may pick up the children early in the case of an “emergency,” but that “the school must be informed in advance.” How would a parent know about an “emergency” in advance? And what is the Center’s definition of an “emergency” and how much “advance” notice must be given? Though LPA asked what constitutes “an emergency,” and how much advance notice is being requested, the notice does not define this. More significantly, as the notice states that “gates will be closing promptly at 08:00 am” and that “parents will not be allowed to enter the campus,” when P2 arrived to pick up their child for a regularly-scheduled, standing appointment and the Center thus had advance notice, but the phones were inoperable and P2 was unable to get on campus, P2 waited in the parking lot, yelling to try and get someone’s attention to come let them in; P2 ended up waiting 15 minutes just to have someone let them in the gate. If there had been an emergency and emergency personnel, such as the fire or police had to get on campus, 15 minutes is a long time to wait, which may pose an immediate threat to the health and safety of the children in care.

The allegation that “Staff are not releasing children to parents at their request” has been determined to be Substantiated, as it is a violation of the Parents Rights, as defined by Title 22, which states thatUpon presentation of identification, the responsible parent or guardian of a child receiving services in a child day care facility has the right to enter and inspect the facility without advance notice during the normal operating hours of the facility.”

This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101218.1 " Admission Procedures and Parental and Authorized Representative's Rights." The complaint alleged that “Staff are not

A finding of Substantiated means that the preponderance of evidence standard has been met. -Pertaining to the allegation that “Facility phone is not working consistently”:

According to the Reporting Party, the facility phone line is not always functioning. Three of the staff interviewed corroborated that the phone system does not always function.

According to Staff #2, the phones have not been regularly working since March 2021, when the phone system stopped being updated. The phones on the Center’s end would not ring when someone called in; thus, the main phone number of the Center was forwarded to the personal cell phones of Center staff. Parents were told they could email the Site Supervisor and Assistant Director if they were unable to get ahold of anyone via phone. The problem was brought to the attention of Administration and the owner since staff from other sites as well as parents were having issues calling in; however, to date, the phone system has not been upgraded, repaired or replaced.



According to Staff #1, it was parents who brought it to the Center’s attention that there are times the phone rings incessantly and no one picks up.

According to Staff #4, the phones were fine until June 2021, when the contractors were remodeling the kitchen windows, and the desks and phone lines were pulled out in the back office; thus, no incoming calls could be received.

According to one of the parents interviewed, when they once phoned the Center to pick up their child for a regularly-scheduled appointment, a message kept saying, "The person is on the other line." No staff were outside and the phones did not forward to any other phones. The parent was thus forced to wait outside of the locked gate until a staff member arrived back to the Center parking lot from lunch.

At least, in case of an emergency within the Center, staff all have their personal cell phones available to call out. However, the issue created was created by the Center itself since, as stated above, parents can only drop off and pick up at certain times; if they want to drop off or pick up outside of these times, they would need to call the Center in advance since their gate code has been disabled due to COVID (as parents have not been permitted to enter the gate and be on campus since March 2020 to help mitigate COVID exposure on campus).

-Pertaining to the allegation that “Facility not providing safe accommodations for children in care”:

The allegation refers to the remodeling of the kitchen being conducted while children are present.

LPA was informed that construction began on or about June 28 and was anticipated to be completed by July 30; but is still ongoing at the time of this writing. The kitchen is located directly across from Room 4. When LPA conducted an initial inspection on July 14, 2021, LPA observed torn plastic in place of the windows and stacked boxes, a microwave, and an electric cord in the hallway in front of the kitchen, which runs alongside the infant playground. Though children do not have direct access to the kitchen unless they are unsupervised, on both 07/14 and 09/22, one door was propped open each time—the first time by the construction worker and the second time by the cook. Though noise could not be heard from inside of room 4 during the 07/14/21 inspection (there was one worker there doing work), it is unknown whether noise was an issue on other days LPA was not present and work was being performed. Parents were given notice about the work in a notice dated June 25, when work appeared to be already underway. “This is a gentle reminder that we have been in the process of renovating our kitchen…” As parents are not permitted on campus, it is unknown whether parents were aware that the kitchen is right across from room 4 and that work was being conducted during daycare hours while children were present. LPA did observe that the workers entered and exited through the designated staff

gate and Director Cordova stated that the laborers took all of their tools, equipment, and materials with them at the end of the day. The main concern is that the infants are not able to play on the playground while construction is being performed, as the laborers and their material is stored in the hallway in front of the infant playground.

However, as construction is being conducted while children are in care and the area is not blocked off or indicated by any sort of barrier, and alternative accommodations were not considered (e.g. work being performed only on weekends or shutting Room 4 or the entire campus down during construction), the allegation that Facility not providing safe accommodations for children in care” has been determined to be Substantiated.

This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 07, Section 101238Buildings and Grounds”. The complaint alleged that “Facility not providing safe accommodations for children in care.” Based upon the evidence as presented above, the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. The allegation refers to the dilapidated wood on the overhanging above the outdoor patio in front of the Office and Room 1, as well as two holes in the flooring of Room 1 and one hole in the flooring of Room 4.

During the inspections conducted on July 14 and September 22, 2021, LPA observed all of the items listed above and took photos as documentation. Though the holes in the flooring in Room 1 are covered by a heavy rug, the hole in Room 4 is not, presenting a tripping hazard.

In addition to the items listed in the allegation, during the July 14 inspection, LPA observed a rain gutter which needs to be repaired, a rug in front of a classroom door which was tattered and the handle on the cabinet of a sink used by the children in Room 4 which was missing, so that the butterfly childproof latch could not be secured, rendering hazardous items such as cleaning compounds and liquid soap accessible to the children. Though the rug and the handle on the cabinet had been replaced by the September 22 inspection, they must be noted.

Both Staff #1 and Staff #2 stated that the flooring is next on the list of items to be repaired or replaced and that estimates from contractors have already been obtained. However, as a contract has not yet been secured and it is unknown for how long the wood and the flooring have been in such disrepair, the allegation that “Facility is not in good repair” has been found to be Substantiated.

This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 07, Section 101238Buildings and Grounds”. The complaint alleged that “Facility is not in good repair.” Based upon the evidence as presented above, the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of

Regulations, Title 22, Division 12, Chapter 1, Article 07, Section 101238 "Buildings and Grounds” is being cited on the attached LIC 9099D.

Please refer to 9099D for documentation of deficiencies.

Upon receipt, the Licensee shall post the Notice of Site Visit and the “D” page of the Licensing report. Both the Notice of Site Visit and the “D” page shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next 12 months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. LPA provided Licensee with a blank copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report.



An exit interview has been conducted with, and a copy of this report has been signed by and provided to Site Supervisor/Program Director Rachel Cordova. Appeal Rights were provided and explained to same.
