Licensing Program Analyst (LPA)Katrina Chicote conducted an Unannounced Required – 1 Year inspection to the above facility on 10/21/2021 at 9:10 AM. LPA attempted to conduct COVID-19 screening call prior to entry into the home, LPA conducted COVID-19 screening questions at inspection. Upon arrival, LPA disclosed the purpose of the inspection and met with Licensee, Trina Lawson, who guided the LPA on a tour of the facility. Also present was Licensee's Assistant who has criminal record clearance. Individuals living in the home were discussed. There were six day care children present during today’s inspection. Licensee's Assistant states that there are currently seven children enrolled. At 9:12AM, LPA observed a large dog in front yard of home that is tied to a post, per Licensee the dog is an indoor dog but is kept tied during daycare hours. The children's roster was reviewed and is current. Per Licensee, the facility’s hours of operation are 24hrs/Mon-Fri. Licensee understands that they cannot provide care for a child longer than 23 hours. LPA discussed overnight care procedure with Licensee at time of inspection, Licensee states she provides a cot in daycare space and remains in same room as child until pick up time. Emergency Disaster Plan, License, and Parents’ Rights were posted at the time of inspection. Disaster drill log was also available during today’s inspection, last disaster drill conducted on 05/18/2021.

This is a two-story home which consists of five bedrooms and three bathrooms, kitchen, living room, and daycare space. Areas used by the children include the daycare space (located upon entry of the home) and Bathroom 1 (located down the hallway, past stairs through living room across from kitchen). Per Licensee, areas off limits to children and parents include entire upstairs which contains three bedrooms and one bathroom, two bedrooms and second bathroom downstairs, living room, and kitchen. At 9:14 AM, LPA observed that there is an operable baby gate in hallway entrance separating areas used by children and off-limits areas. At 9:16 AM, LPA observed operable sliding gate partition at bottom of stairs making area upstairs inaccessible to children in care at time of inspection.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. LPA observed central air/heating through the home. There is a working telephone maintained in the home. At 9:18 AM LPA observed Main Daycare Space to have large child size corner couch, reading area, television, shelves filled with magnetic toys, art supplies, puzzles, blocks, dress up, dramatic play, and other age appropriate toys, free of loose and sharp parts available for children in care at time of inspection. At 9:27 AM, LPA observed Bathroom 1 that children will have access to through hallway to have operable toilet and double sinks, functioning child safety locks on under sink cabinets, and floor to be free of hazards at time of inspection. Per Licensee, children will have access to Bathroom 1 by walking, with supervision, through off limit living room and kitchen. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. At 9:30 AM, LPA observed back laundry area in off limits kitchen to contain these items in a closet with operable child safety lock at time of inspection. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked with a key or combination lock.

Per Licensee, the children will have access to backyard area for outdoor play. Backyard is accessible through a backdoor located in the kitchen. At 9:38 AM, LPA observed backyard has turf grass, concrete and adequate perimeter fencing through-out the yard. LPA observed plastic play structures, child appropriate bicycles, and other age appropriate toys free of loose and sharp parts available for the children in the backyard and all trees, shrubs, and plants are maintained. LPA observed four storage sheds in backyard of the home that Licensee states is inaccessible to children, LPA observed locks on storage sheds at time of inspection.

Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPA observation did not see these items around the premises. Per Licensee, they provide food for children in care.

At 9:34 AM, LPA observed the valve on the required 2A 10BC fire extinguisher indicates fully charged. At 9:32 AM, LPA observed smoke and carbon monoxide detectors are in operable condition at time of inspection. Per Licensee, First Aid kit is kept in the hall closet next to daycare space, LPA observed First Aid kit and was inventoried for necessary supplies. The Licensee's Assistant has current Pediatric First Aid and CPR. Proof of immunization against influenza, pertussis, and measles was readily available during today’s inspection. The Licensee has also taken the Mandated Reporter Training.

Incidental Medical Services (IMS)
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee states she is working on updating sick policy at this time, but does conduct morning health checks and would separate a sick child depending on where children would be located at the time.

Licensee (or facility representative) was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Rooms that are off-limits need to be made inaccessible during operating hours. NO smoking, NO infant walkers, NO Johnny jumpers, NO saucer chairs, NO incline sleepers and any other item that falls into that category are permitted in the facility. Effective January 1, 2010, licensees of family child care homes are required to ensure that at least one staff member with current training in pediatric first aid and pediatric CPR is on site at all times when children are present.



The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care. Sudden Infant Death Syndrome (SIDS) and Never-Shake-a-Baby were discussed. A hard copy of Lead Handout, PIN 20-24-CCP Recently Approved Safe Sleep Regulations, LIC 9227, was provided at time of inspection.

AB 1207: Beginning on January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training. Website: http://www.mandatedreporterca.com/

Senate Bill 792: this bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles. LPA discussed the influenza waiver during the visit.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today 10/21/2021.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
