On 4/12/2023 at 10:00 am, Licensing Program Analyst (LPA), Carolyn Tuba conducted an annual inspection for the above facility. LPA met with Licensee, Mirna Ramirez, who guided Analyst on a tour of the facility. LPA observed two (2) children in care at the time of inspection. During the visit an additional child arrived making the census three (3) children in care. Per Licensee, eleven (11) children are currently enrolled at this time. A facility roster was available. Per Licensee, operating hours are from 4 am – 7 pm Monday - Friday. The licensee is part of a food program for children in care, breakfast, snacks, lunch, and dinner.

This is a single-story home consisting of four bedrooms, two bathrooms, kitchen, living room, dining area, front yard, backyard, and side yard. Children have access to the living room, dining area, bedroom #1 and #2 and the bathroom near bedroom #1 and #2. Bedroom #1 is used as an isolation room for ill children. Per Licensee, the kitchen, bedroom #3, #4 and bathroom closest to bedrooms #3, #4, side yard and front yard are off-limits to children in care. The home was inspected for safety, comfort, cleanliness, ventilation, and telephone service (cell phone).

Currently residing in the home are Licensee, and two (2) adults and one (1) minor child. Licensee was informed that all individuals must obtain a criminal record clearance or exemption prior to working, residing, or volunteering in a licensed home. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Detergents, cleaning compounds, medications, and other items, which could pose a danger, were determined to be inaccessible to children in care during this inspection.

LPA observed the required 2:A-10:B-C fire extinguisher and per Licensee it had been purchased April 2022. LPA advised that Fire Extinguisher is expiring this month and suggested it be serviced or to purchase a new one. Per State Fire Marshall standards, fire extinguishers shall be service annually. The smoke detector and carbon monoxide detector were working properly. Per Licensee, there are no weapons, firearms, or bodies of water on the premises. Additionally, there are no pets on the premises, but Licensee did mention they may be acquiring a pet in the near future and asked what the requirements were for having pets.

LPA advised the Licensee with regards to safe sleep and that infants under 24 months shall be checked on every 15 minutes and the time of each 15-minute check shall be documented with child’s name, date and initials of the person who checked on the child. LPA provided Licensee a booklet on Safe Sleep. LPA conducted consultation on immunization needed for the assistant, mandated reporting training. LPA stated to Licensee that she did not have on file a Statement Acknowledging Requirement To Report Child Abuse (LIC 9108). Licensee provided the (LIC 9108) on herself and her assistant.

LPA provided copies of Parent Rights and the Seat Law for parent board. Licensee filled out a new Application updating information that had changed and a new Current Children in the Home (LIC 279B) for the Department’s file. Licensee updated changes with the Sketch for off-limit and on-limit areas that the LPA has obtained and will place in the Department file. The licensee is observed to be operating within the license capacity limitations. LPA did not observe any children left in parked vehicles. Car seats shall only be used for transportation. LPA did not observe any children sleeping in car seats.

The licensee have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee Pediatric First Aid and CPR expire on 6/2023, which includes the EMSA sticker. There are first aid supplies available. Licensee currently have the mandated reporting training certificate AB 1207, which expires January, 2025.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be enclosed with a retaining wall and wooden fence. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children in the outdoor yard.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.css.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee’s husband of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

At this time, the licensee is in compliance with California Code of Regulations Title 22. No deficiencies cited.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
