Licensing Program Analyst (LPA) Reiko Jones-Modeste conducted an unannounced Complaint Inspection regarding the above allegations. LPA met with Site Supervisor in Charge Jaritza Jimenez who gave a tour of the facility. At 10:15am LPA observed the Garden Room with seven infants at play on the playground, the Sunshine Room with seven preschoolers and the Butterfly Room with nine preschoolers. At 12pm Site Supervisor Sylvia Correa arrived at the facility. During the course of this investigation, LPA observed children at play, enjoying mealtime and napping. During confidential interviews staff nor parents and children in care confirmed or corroborated any abuse or food service issues. LPA observed children awaken from naps at their leisure. LPA observed children being served healthy, unspoiled lunch and snack on three separate occasions. LPA also observed thermostats with appropriate temperatures reflecting current weather. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
Exit interview was conducted with Licensee. The Licensee was provided a copy of their appeal rights as well as a Notice of Site Visit. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

On 11/19/19 during confidential interview with C1 and C2 neither confirmed any abuse and confirmed meal and nap time protocol.

On 10/4, 11/6 and 11/19/19 LPA observed snack time, nap time as well as stored food in both the refrigerators and cabinets. Food was safe, healthy and unexpired. Children awakened from naps at their leisure. LPA observed children being served healthy, unspoiled lunch and snack on three separate occasions.

On 10/4 and 11/19/19 LPA observed complete and appropriate children and staff records.

On 10/4, 11/6 and 11/19/19 LPA observed thermostats with appropriate temperatures reflecting current weather.
