An unannounced complaint inspection was made on this day by Licensing Program Analyst (LPA) Ariel Cazares to the licensed day care. LPA met with Director Candace Wong to discuss the above allegations. At the time of arrival LPA observed 13 children and 2 additional staff.

An investigation was conducted and concluded by LPA Ariel Cazares. LPA conducted interviews with complainant, staff, children and other individuals. Per complainant, the director was observed handling a children in a rough manner, pulling on the children's sweater hoods or their arms. Name of children were not known. Complainant reveleaed that Child #1 was swatted on the buttocks by a staff, as observed by another adult. Complainant disclosed that director yells and argues with staff in front of children. Complainant stated witnessing this and being told by others.

An unannounced complaint inspection was made on this day by Licensing Program Analyst (LPA) Ariel Cazares to the licensed day care. LPA met with Director Candace Wong to discuss the above allegations. At the time of arrival LPA observed 13 children and 2 additional staff.

An investigation was conducted and concluded by LPA Ariel Cazares. LPA conducted interviews with complainant, staff, children and other individuals. Per complainant, Staff #1 yells at children when they are not listening. Complainant stated hearing Staff #1 yell at other staff.

LPA conducted interviews with staff who denied the allegations. Staff denied yelling at children and/or being yelled at in front of children.

LPA interviewed children in the facility. One child disclosed that Staff #1 yells loudly at others and that the child feels sad.

Other individuals were interviewed who have been present in the facility. Individual #2 disclosed witnessing Staff #1 yell at a child "to do something". Individual #2 also disclosed Staff #2 yelled at a child who hit another child. Individual #2 described the yelling as a "reprimanding way." Individual #2 stated that they were not visible to the staff when this occurrence happened.

Based on interviews conducted and disclosures made, along with complainant's report the preponderance of evidence standard has been met, therefore the above allegation of "Facility staff yells at children" is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Section 101226, is being cited on the attached LIC 9099D.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.

Exit interview conducted and a copy of this report was left with Director Candace Wong. A copy of the appeal rights were provided and explained.

A "Notice of Site Visit" and copy of the report was issued. Notice of Site Visit must remain posted for 30 days. Failure to do so will result in a $100.00 civil penalty

This report must remain on file for three (3) years. This report must be posted for 30 days in clear view, at the entrance of the Rosemead Christian Preschool. The report can not be covered/concealed.

LPA interviewed facility staff and there were no disclosures to support the allegations. Staff denied handling children in a rough manner or withholding food and water as punishment. Staff denied witnessing other staff engage in these actions towards children.

LPA interviewed additional individuals who have been present in the facility. Individual #1 was mentioned as being a witness to the allegations. LPA interviewed Individual #1, who denied observing or witnessing the facility mishandle children. Individual #1 denied observing staff withhold water or food as a form of punishment. Individual #1 denied witnessing staff engage in altercations with others in front of children. Other individuals interviewed made no disclosures about concerns with food or water being withheld from children. There were no disclosures of witnessing staff engage in altercations with each other or other adults in front of or away from children.

LPA interviewed children in the facility. There were no disclosures from children of staff mishandling them or grabbing them. One child demonstrated to LPA hand holding when asked if a teacher grabs the child. Child did not make disclosures about not having food or water available to them. Two children disclosed that when a child gets in trouble they must sit on a bench.

Throughout the complaint investigation and inspections, LPA did not observe the allegations occurring in the facility.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
