25 | Licensing Program Analysts (LPA's) Bardo Baluyot and Crystal Green conducted a unannounced case management inspection to the above facility for a capacity increase. Licensing is requesting to increase from a small family home to a large. Upon arrival LPA's were greeted by Licensee's spouse, Xiaoming Miao. Also present was Licensee Liqing Gao. Due to licensee primarily language being Chinese licensing staff communicated through Licensee's spouse.
At approximately 1:17 pm upon entry of the home, Licensing staff observed 6 infants located in the living room area, 4 children were observed napping in cribs and 2 were observed napping on mats on the floor. LPA's then observed the licensee coming from the hallway with an additional infant in her arms going into the bathroom. Census was immediately taken to be at 7. Per Licensee spouse, none of the children observed present was enrolled in school. California Code of Regulation Title 22 Section 102416.5(a) states a small family day care home may provide care for more than six and up to eight children, however the seventh child must be in enrolled in and attending kindergarten or elementary school. After conducting a file review it wasw determined that all the children present were under the age of 3. Licensee's was directed by licensing staff to call a parent to have one child picked up. Mother arrived minutes after at approximately 1:43 pm. At this time, facility is not in compliance and their request for a capacity increase is under review. See 809d.
Exit interview was conducted with Licensee and Licensee's spouse. Appeal rights have been provided and explained. The Notice of Site Visit (LIC9213) -must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.
Note:* Any Licensing reports indicating a Type A deficiency shall be posted immediately and for the next 30 days and copies provided of this licensing report to parents/guardians of children in care and newly enrolled children, and for failure to maintain written verification of receipt of licensing reports indicating a Type A violation (LIC 9224) |
