Licensing Program Analyst (LPA) Janeth Chavez conducted an unannounced inspection regarding the above complaint allegation and to deliver findings. LPA met with Vanessa Almanza and toured the facility to take census of the children present. There are 6 children present and 2 staff. Teacher-child ratio met. All adults present have obtained a criminal record clearance or exemption.

The reporting party stated that Staff #1 is purposely rude to Child #1 and that the reporting party witnessed when Staff #1 commanded Child #1 to get off the tetherball. Reporting party stated that Staff #1 did not yell at the child but her tone was very rude. Also, that Staff #1 is not the child’s teacher but interacts with Child #1 during nap time and during outside play. Also, that Staff #1 does not allow Child #2 to use the pacifier even though the child needs it for soothing purposes due to trauma suffered in the past. During the course of the investigation interviews were conducted with reporting party, Staff #1, and random parents.

Staff #1 denied the allegation. Mrs. Almanza stated that currently there are only 20 children enrolled in this facility. Therefore, the daycare children from the Bunnies, Dragonflies & Little Bears classroom nap together in the Bunnies classroom. Also, during outside play the daycare children are all together on the playground and are directly supervise by the staff present including Staff #1. That Gloria Portillo (former Director) spoke to reporting party and the agreement was that the pacifier will be used by Child #2 during nap time for soothing purposes. There were no disclosures or admissions made by staff or random parents. Child #1 & 2 are currently enrolled in the facility and are not directly supervise by Staff #1 except during nap time and outside play. Based on the investigation conducted by the Department the allegation that, Staff is speaking inappropriately to day care child is unsubstantiated.

Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the above allegation is unsubstantiated.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. There are no deficiencies cited on today's inspection.



Exit interview was conducted with Vanessa Almanza, including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role.
