Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Director Anntoinette Jordan.

During the course of this investigation, LPA Lee conducted interviews, reviewed documents, and made observations in regards to the above allegations.

The complaint alleges that Child#1 was not taken to his elementary school from the facility and that Child#1 was picked up late by the facility from his elementary school. The Director stated that she does recall the incident where Child#1 was accidently not taken to school. The Director stated that there was a mix up with the start time for Child#1 by a staff member who was suppose to take the child to school in the morning. The Director stated the parent was notified of the mix up in the morning and the child did not end going to school that day. The complaint also mentions that Child#1 was picked up late in the afternoon by the facility.

During an interview, the Director was asked by LPA Lee if Child#1's elementary school ever notified the parent/guardian of Child#1 that the child was not picked up despite a certain amount of time passing. The Director stated that she does recall the mother being called by Child#1's elementary school and then calling the school wondering what had happened. The Director stated that there was a mix up regarding Child#1's pick up time and that schedule has been revised so that Child#1 was picked up on time afterwards.

During the file review for Child#1, LPA Lee observed that the facility did not have any type of specific documentation regarding the transportation service that was provided for the children. The facility parent handbook and admission agreement does mention transportation services as an option for parents, but there was no additional documents that provided details what type of service is available and who would be providing the actual transportation. During an interview, the Director stated that the transportation is coordinated between her and the other staff members of the facility. During the investigation the Director did provide a list of staff members who do provide transportation, and examples of pick up and drop of schedule for staff members to follow during a normal business day.The facility was advised to amend their admission agreement so the transportation section of the agreement can provide more specific information reader about the service it self.

Based on the information obtained during the investigation, the preponderance of evidence standard has been met, therefore the allegation that facility is commingling children has been substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 6), is being cited on the attached LIC 9099D.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.

The licensee shall ensure that each child is accorded the following personal rights:To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by the fact that the facility agreed to provide transportation for Child#1, but the child was not taken to his school

The facility agreed to amend their admission agreement so that the transporation service provided by the facility is more specific, and transparent regarding the specific arrangements made with a parent of a child who wishes to be provided with these type of services.
