32 | Allegation: Day care children are left unsupervised due to inadequate staffing.
According to the allegation, when there is only one teacher present in the classroom,
the teacher is not able to visually supervise all children in care while changing a child’s
diaper in the bathroom. During interviews, Staff #1, #3, and #5 stated they had
changed a child’s diaper in the bathroom while being the only staff in the room, and not
being able to visually supervise all the other children in the classroom. Staff #5 states,
“There is definitely a blind spot”.
Based on LPAs interviews that were conducted, the preponderance of evidence
standard has been met, therefore the above allegation is found to be
SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, is
being cited on the attached LIC 9099D.
A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of
$100.
An exit interview was conducted, and the report was reviewed with Executive Director of Child Care, Margot Villa.
