On 06/29/2023 at 2:30 PM, Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. A COVID 19 risk assessment was conducted prior to entering the facility- appropriate PPE was used. LPA met with facility Director Claire Chou during the visit. Census was taken-. facility was within ratio & capacity.

Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.

Facility has not provided required forms LIC 9276, LIC999 (facility sketch) and LIC 9275 to the department- as it was their understanding the water company was going to do it. LPA advised that documents need to be completed and send in to the department. On 6/15/2023, the Department received notification from the State Water Resources Control Board(SWRCB), Division of Drinking Water (DDW).

Faucets reported with 5.5 ppb or greater lead exceedance levels were as follows:
  • Staff lounge faucet (12 UG/L) – During inspection LPA observed faucet has been replaced and it is in an off-limits area for children. Pictures were taken
  • Playground fountain towards the back of the playground (11 UG/L) – During inspection LPA observed fountain to be covered by a taped plastic bag and a sign stating it is out of order.
Director stated that the staff lounge faucet has never been used by children but has been replaced and will be retested. The water fountain has been made off limits as of now- their handy man is looking for the parts to be replaced. Per Director, children bring water from home and they also have water available to refill. Once fountain is replaced they will test both staff lounge faucet and playground water fountain and submit results to the department.

A notice of site visit was also provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on ispection, the licensee did not comply with the directive above, as that 2 out of 12 faucets tested with an Action Level Exceedance (ALE) of 11 ppb and 12 ppb. This poses a potential health and safety risk to children in care
