On November 14, 2024 at 1:34 PM, Licensing Program Analyst (LPA) Jonnisha Culbert conducted an unannounced annual/random inspection at the facility noted above and met with Licensee, Andrea Santos. LPA disclosed the purpose of today’s visit, provided licensee with an Entrance Checklist (LIC) 126, and requested a tour of the facility. The operating hours are Monday through Friday from 7:00 AM to 5:30 PM. Individuals residing in the home were discussed and noted. At the time of the inspection, the Licensee, assistant 1, and 8 children were present.

All areas identified on the facility sketch were inspected. This facility is a single-family home that consists of 3 bedrooms, 2 bathrooms, living room, dining room, kitchen, detached garage (converted to day care room), fenced pool area and fenced backyard.



Areas that are accessible to children include: 2 bathrooms, living room, dining room, kitchen, detached garage (day care room), and fenced backyard. Per Licensee, the children utilize the fenced backyard for outdoor activity.

Areas off-limits to children include: 3 bedrooms and fenced pool area located in the backyard. LPA observed the bedroom doors closed, but not locked. Licensee was advised that off-limit areas must be made inaccessible during operating hours or while children in care are present. LPA also observed the above-ground pool fenced per licensing regulations.

The following documents were posted on a board located in the garage: Facility License, earthquake preparedness, and parent’s rights. Licensee has a Facility Roster (LIC 9040) available for review. Licensee has verification of Disaster and Fire Drills available for review. The last drill was conducted on 09/30/2024.

Based on observation, record review, and interview, the licensee did not comply with the section cited above and fire extinguisher does not have a service tag to show when it was last service. Per licensee, fire extinguisher was purchased sometime last year. LPA reviewed last report and observed that licensee did not provide proof during last annual inspection. This poses a potential safety rights risk to persons in care.

home does not have any fireplaces or wall heaters. Per licensee, the home has central heating and air, and the garage also has heating and air via wall unit. There are 2 dogs that were kept on the side of the house during the inspection. Licensee was advised that best practice is to keep pets isolated from children in care. Knives and sharp objects were made inaccessible to children. Per Licensee, there are no firearms or poisons kept in the home. Licensee was advised that if any poisons are purchased, it is required to remain in a location that is locked and inaccessible to children. LPA observed cots, for napping, stored inside the garage. Licensee was reminded that the garage cannot be used for napping or eating. Per Licensee, children eat and nap in the living room.

LPA observed the required fire extinguishers (2-A:10-B:C) that was fully charged however, licensee was unable to provide proof of when the fire extinguisher was purchased or last serviced. This is a potential safety risk to persons in care. Licensee was reminded to have the fire extinguisher serviced yearly. Smoke detector and carbon monoxide detector were located in the home, and they were tested and are operable. Per license, first aid kit and emergency supplies are available and kept in are kept in the home. Per licensee, breakfast, lunch, and two snacks are provided to children in care. Licensee was reminded that food that is brought from the child's home shall be labeled with the child’s name and properly stored or refrigerated.

LPA conducted a record review of 3 children's record, Licensee's record, assistant record. All children files were complete in ready for review. Licensee and assistant completed the Pediatric First Aid and CPR training on 12/10/22 . Per licensee, they are schedule to renew certificates together. Licensee’s mandated reporter training was completed on 05/2/2024. Assistant’s mandated reporter training was completed on 11/18/2022. Licensee was advised that the Mandated Reporter training (AB 1207) must be completed every 2 years and is available at www.mandatedreporterca.com.



Licensee and assistant has proof of immunization against measles and pertussis. They have a TB clearance and decline declaration statement for influenza.

Licensee Andrea Santos was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, Andrea Santos, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

One B citations was cited during today's visit in accordance with Title 22, California Code of Regulations. Appeal rights were provided to Licensee. Please see attached LIC 809D. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
