At 8:35 am Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced required 1-year inspection to the above facility. A COVID risk assessment was conducted upon entry and appropriate PPE was used. LPA met with Licensee, Bernandita Moreno, to whom the reason for the visit was explained. Per Licensee, there are 8 children currently enrolled, including 6 infants. There were 7 children present upon arrival (child # 1, 2, 3, 4, 5, 6, and 7) including 5 infants (child #1, 2, 3, 4 and 6). Licensee’s husband was also present; however, no assistant was present in the home during the inspection. Licensee stated the assistant (staff #2) was not able to come to the facility on this day. LPA discussed being out of ratio with licensee and reviewed capacity handout with licensee. Licensee stated one additional infant (child #8) was probably on her way. LPA advised licensee to call parent of child #8 to let her know that she would not be able to care for the child at this time. LPA advised licensee to have additional children picked up to be in ratio. At 10:36 am, child #8 arrived and licensee informed parent she would not be able to care for the infant today. At 10:43 am, child #1 (infant) was picked up by father. At 11:19 am, child #3 (infant) was picked up by parent. At 11:19 am, facility regained ratio compliance. LPA discussed creating a compliance plan with licensee, which would document how her facility, from today forward, will maintain an appropriate child ratio for her license. Licensee wrote compliance plan on a declaration (LIC 855).

The licensee states that 2 adults and no children currently live in the home. All adults living in the home have obtained a criminal record clearance.

Based on LPA observation, interview with licensee and childrens record review of ages of children, the licensee did not comply with the section cited above by having 5 infants and 2 preschool aged children in care during inspection which poses an immediate health, safety or personal rights risk to persons in care.

During LPA's inspection, child #1 and child #3 were picked up by a parent, and parent of child #8 was informed during drop-off that she could not care for child today. LPA obtained a LIC 855 declaration from licensee, which includes a compliance plan for licensee to be in ratio and within capacity limits going forward.

This is a one-story home which consists of 2 bedrooms, 1 bathroom, living room, dining room, kitchen, office, detached garage, front yard, and backyard which is fenced.

Per licensee, areas off limits to children and parents include 1 bedroom, kitchen, office, garage, and front yard. The children have access to living room, dining room, one bathroom, one bedroom used for napping, and backyard which is fenced.

Licensee guided analyst on a tour of the facility. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed.

Facility License, Emergency Disaster Plan, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the home. A current children’s roster was available for review.

There is telephone service via a landline and a cellphone in the home. Hours of operation are Monday – Friday, 7:30 am – 5:30 pm. There is central air and heating in the home. LPA observed a fireplace in the living room that is barricaded by a couch making it inaccessible to children.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Poisons are locked in the off-limits garage. LPA advised that any poisons should be locked under key or combination lock. There is one firearm in the home, which was observed to be in an inaccessible bedroom closet, stored in a locked case with a key lock. A childproof doorknob was observed on the off-limits bedroom door on this day. Ammunition is stored separately in the inaccessible bedroom.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 5/6/22, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 5/9/22.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children. Appropriate sleeping arrangements in form of 2 cribs, 3 playpens and one cot were observed in the bedroom used for napping.

Licensee states that she is currently caring for 6 infants. LPA Babcock did not observe a sleep log or Individual Infant Sleep Plan (LIC 9227) for the infants and licensee stated she was not aware of the sleep log or sleep plan regulations. LPA consulted with licensee regarding safe sleep regulations.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. No bodies of water were observed on this day.


At 9:30 am, children’s records were reviewed, including emergency information, and 5 of 8 children’s files were observed to be missing form LIC 282, regarding Liability Insurance

At 10:00 am Licensee and staff records were reviewed, and LPA observed that Licensee and

licensee’s current assistant (staff #2) did not have Mandated Reporter Training. The licensee has completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 5/3/24.

LPA issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

There is 1 dog on the premises. Per licensee, the dog is kept in off-limits areas during daycare hours.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA also informed licensee Bernandita Moreno of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. A notice of site visit was given and must remain posted for 30 days.

LPA Lilli Babcock informed licensee Bernandita Moreno that this report dated 5/27/22 documents 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Lilli Babcock informed the licensee to provide a copy of this licensing report dated 5/27/22 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.


Based on the LPAs observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.
