At 8:45 am Licensing Program Analysts (LPA) Roxana Lopez conducted an unannounced required 1 year inspection to the above facility. A risk assessment was conducted prior to entering the facility- appropriate PPE material was used. LPA met with Maria Castellanos, Assistant who then called Licensee, Jose Alcantar who guided analysts on a tour of the facility. Per Licensee, there are 7 children that are currently enrolled. A current children’s roster was available for review. There were 5 children present upon arrival.

The licensee states that 2 adults currently live in the home. Per Licensee, he currently has one assistant. At 8:50 am during the walk through of the facility LPA observed that Staff # 1 Maria Castellanos, Assistant is not fingerprint cleared. LPA called the Regional Office and determined through Licensing Information System (LIS) and Guardian that Assistant Maria Castellanos shows up in the facility roster but her fingerprints are not cleared. Licensee, stated that Maria has been living in the facility and employed with the facility since the 2019. This poses and immediate risk to the health and safety of children in care. A civil penalty of $500 was assessed on this day.

This is a single story home which consists of 2 bedrooms, 2 bathrooms, kitchen, living room, dining room ,den, front yard, backyard (fenced) and unattached garage. The children have access to living room, dinning room, den, 2 bathrooms, backyard (fenced) and unattached garage that is used as a play room. Per licensee, areas off limits to children and parents include: 2 bedrooms, kitchen and front yard. The LPA toured all areas used by children during this visit. The licensee provides food for children in care.

All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a cellphone that is used and the cellphone stays at the

facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

Detergents, cleaning compounds, medications, and other items which could pose a danger to children were not observed to be accessible to children. Poisons are locked in the shed that is located behind the garage. The restrooms that children use were observed to be safe and sanitary. Licensee states that there are no firearms stored in the home.

LPA observed an open face heater which is inaccessible to children. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 4/12/2021, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Last drill documented was conducted on 7/8/2021.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the dinning room.

The home is observed to be clean and orderly. There are toys available for children. Appropriate sleeping arrangements in form of mots were observed.

Licensee states that he is not currently caring for infants. LPA advised the licensee to sleep infants where they can always be directly supervised and advised the licensee against sleeping infants in a separate room. Licensee states that infants sleep in the den room where they will be constantly supervised. LPA reviewed the Individual Infant Sleeping Plan LIC 9227 with licensee.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children on the outdoor yard.

There are no pets on the premises

The licensee is observed to be operating within the license capacity limitations

At 9:44 am children’s records were reviewed, including emergency information and were observed to be complete.



The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 11/10/2021. There are first aid supplies available.

At 10:10 LPA observed that the Licensee and assistant do have proof of immunization record and the Mandated Reporter AB 1207 compliant Child Care Training Certificate expired on 3/20/2018 .

LPA issued a Confidential Names List (LIC 811) to the licensee which documents staff and children’s files reviewed during this inspection.



Incidental Medical Services (IMS):
The licensee states that he will provide IMS. Per licensee, there are no children enrolled that require IMS at this time. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA advised the licensee to access forms, regulations and quarterly updates on line at: www.ccld.ca.gov.

The following was discussed with the Licensee:

Individuals who are 18 years of age or older living in the home must obtain a criminal record clearance. Individuals within one month of their 18th birthday must be fingerprinted immediately. Failure to obtain criminal record background check clearances prior to initial presence in the home will result in an immediate $100.00 dollar or more per day Civil Penalty.

In the absence of the Licensee, a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current adult/infant CPR & Pediatric First Aid certification and a valid criminal record clearance associated to the facility license.

Based on the LPA’s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.



Upon receipt of a report documenting a Type A deficiency, the licensee shall do the following:

1. Health and Safety Code Section 1596.8595 (c) - A licensed child care facility or home shall provide to the parents of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as specified in paragraph (1) of subdivision (a) of Section 1596.893b. Failure to comply with paragraph (1) shall result in an immediate civil penalty of one hundred dollars ($100).

2. Each licensed child day care facility shall post a copy of any licensing report pertaining to the facility that documents either a facility inspection or a complaint investigation that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. Failure to comply with paragraph (1) shall result in an immediate civil penalty of one hundred dollars ($100).

3. Upon enrollment of a new child in a facility, the licensee shall provide to the parents or legal guardians of the newly enrolling child copies of any licensing report that the licensee has received during the prior 12-month period that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b.

4. The licensee shall require each recipient of the licensing report described to sign a statement (LIC 9224) indicating that he or she has received the document and the date it was received. The Acknowledgement form (LIC 9224) must be maintained in each child’s file immediately upon receipt from parent. A copy of the parent Acknowledgement of Receipt of Licensing Reports Form was provided during this inspection.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
