Licensing Program Analyst (LPA) Elka Chavez conducted an unannounced case management inspection. LPA met with licensee, Araceli Flaharty who guided LPA on a tour of the facility. Also present was Licensee's Assistant. There was a total of four children present during today's inspection.
The purpose of this inspection was to inspect the fish pond located in the backyard. LPA observed the fish pond to be surrounded by an iron metal fence that is anchored to trees planted along the fence of the backyard. LPA observed a metal cover on top of the fish pond. LPA observed the fence to be 3.5 feet high from the ground and 3.4 feet from the metal cover on top of the fish pond. The fence is designed and installed so that children are unable to remove it. LPA did not observe gaps providing direct access to the fish pond. LPA observed the horizontal railing are at least 45 inches apart. LPA observe the cover on the fish pond to be secured and locked in place so that children cannot slip under or undo. LPA observed the licensee tug on the fence and it appeared to be sturdy.
Based on the LPA’s observation, the following corrections need to be corrected prior to obtaining a large family child care license. Corrections are due by 06/21/2021.
· Licensee needs to place a fence around the fish pond that meets title 22 requirements 102417(g)(5)
Exit interview was conducted with the Licensee, Araceli Flaharty. Appeal rights were provided. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site inspection by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
