At 8:40 am Licensing Program Analyst (LPAs) Lilli Babcock and Mary Silva conducted an unannounced required 1-year inspection to the above facility. A COVID risk assessment was conducted upon entry and appropriate PPE was used by LPAs. LPAs met with Licensee, Marianela Diaz, to whom the reason for the visit was explained. Per Licensee, there are 14 children currently enrolled. There were 8 children present upon arrival. The licensee was observed to be operating within the license capacity limitations.

The licensee states that 1 adult child currently lives in the home and no minor children. Per Licensee, there is one assistant in the facility. All adults living in the home have obtained a criminal record clearance.

This is a one-story home which consists of 3 bedrooms, 2 bathrooms, living room, dining room, kitchen, day care room (converted garage), front yard, and backyard which is fenced.

Per licensee, areas off-limits to children and parents include 2 bedrooms, 1 bathroom, and front yard. The children have access to kitchen, dining room, living room, one bathroom, one bedroom (napping room), daycare room and backyard which is fenced. Licensee stated parents drop off and pick up children from the side door to access the day care room.

Licensee guided analyst on a tour of the facility at 8:55 am. During this visit, all areas identified on the facility sketch that are accessible for children to use were toured and inspected and the following was observed.

Facility License, Emergency Disaster Plan, Parent’s Rights Poster, and Earthquake Preparedness Checklist were observed to be posted in the entry way of the home. A current children’s roster was available for review.

There is telephone service via a cellphone that stays at the facility during operation hours. Hours of operation are Monday – Friday 7:00am-6:30pm. There is ventilation and central heating in the home. Licensee stated all meals are prepared for children. The designated area for isolation when children are ill is in the living room.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per Licensee there are no poisons in the home. Licensee states that there are no firearms or weapons stored in the home.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 8/29/2022, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable on this day.

All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. Last drill documented was conducted on 06/05/2023.

The home is observed to be clean and orderly. There are first aid supplies available. There are age-appropriate toys available for children.

Licensee states that she is currently caring for one infant, aged 10 months. LPAs observed a sleep log for the infant.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPAs observed that the outdoor yard has toys and other materials for children to play with.

At 10:30 am children’s records were reviewed, including emergency information and were observed to be complete. Page 2 of 5

At 9:55 am Licensee and assistant’s records were reviewed, and LPA(s) observed that Licensee was pending verification of preventative health and safety certificate and assistant was missing results of Tuberculosis test. A technical violation was issued on this date.

The licensee and other personnel have completed training of Pediatric First Aid and CPR from American Heart Association. Pediatric First Aid and CPR expires on 4/2025 for licensee and assistant. Mandated Reporter Training expires on 04/18/25 for licensee and for assistant on 05/20/25.

LPA(s) issued an LIC 857, Children’s Record Review, and LIC 859, Staff Record Review to the licensee which documents staff and children’s files reviewed during this inspection.

There is one dog, one cat and four birds on the premises. Per licensee, the dog is kept in off limits areas during daycare hours.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, and/or any other item that fall into these categories are not permitted in a family childcare facility.

Licensee, Marianela Diaz was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA(s) discussed the safe sleep regulations with licensee, Marianela Diaz and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPA(s) also informed licensee, Marianela Diaz of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.


Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee, Marianela Diaz was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee Marianela Diaz, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

At this time, the licensee is in compliance with California Code of Regulations Title 22. No deficiencies cited

A notice of site visit was given and must remain posted for 30 days.
