Licensing Program Analysts (LPA) Cynthia Reyes conducted an unannounced site inspection to investigate the complaint allegation listed above. LPA met with Rosalind Jones, licensee who guided the LPA on a tour of the facility. Due to COVID- 19 precautionary measures were taken by the LPA who wore appropriate personal protective equipment during the entire inspection. Also present on this date was Co-licensee Daisy Soto with 7 day care children in the garage. LPA reminded both licensee that there is to be no eating or sleeping in the garage. LPA had licensee Rosalind update the children roster and gave LPA a copy during todays visit. . .

Based upon LPA interviews and documents reviewed and received, it was stated that the child's water cup had been cleaned by the licensee, but may have collected the mold during the weekend by the cup being stored and not completely dried after it was cleaned. It was also observed that there was mold at the bottom of the cup as well as little black dots all over and small particle's floating in the cup when the child drank water from it. Licensees both stated they observed the mold when the parent showed them the cup.

This requirement is not met as evidenced by: Corroborating statements given that the child's water cup did have mold when child took it home from the day care.

Based on the available information, the preponderance of evidence standard has been met, therefore the allegation of Personal Rights Licensee provided day care child with mold contaminated water is found to be Substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 1), is being cited on the attached LIC. 9099D

LPA Reyes informed licensees Rosalind Jones and Daisy Soto that this report dated 07/13/2022 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Reyes informed the licensees Rosalind Jones and Daisy Soto to provide a copy of this licensing report dated 07/13/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was issues to the Licensee.

Licensees stated they will update their Admission Agreement documenting new policies for water bottles being used at the day care and will write a declaration on how they will ensure an incident like this does not occurs again. Licensees will send documents by the POC date of 07/22/2022.
