32 | This agency has investigated the complaint alleging that, “Childcare is operating over ratio”. Allegation regarding “Childcare is operating over ratio”: According to the allegation, Licensee had been operating over ratio beginning 12/24/2021. Reporting Party (RP) alleged that during specific times in the morning hours, one (1) staff member was observed to be caring for six (6) infants.
Through interviews conducted, LPA found corroborating statements that on several occasions, one staff was left to care for more than four (4) infants in the morning hours. Sign-in sheets provided by director also revealed that on 1/3/22 Staff #1 was left to care for six (6) infants and on 1/6/22, Staff #4 was left to care for five (5) infants. Though ratio violations occurred for a short time in the morning hours, LPA's investigation concluded that Licensee failed to maintain ratios at all times. Therefore, this agency has investigated the complaint alleging “Childcare is operating over ratio” and have found that the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter Number 1), are being cited on the attached LIC. 9099D. One Type A deficiency was cited during today’s visit.
Upon receipt of this report documenting a Type A deficiency, the Licensee shall do the following:
1. Post the Notice of Site visit and any licensing report documenting a Type “A” deficiency.
2. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty.
3. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year).
4. The Acknowledgement form (LIC 9224) must be maintained in each child’s file immediately upon receipt from parent. A copy of the parent Acknowledgement of Receipt of Licensing Reports Form was provided during this visit.
