Licensing Program Analyst (LPA) Thelma Razo made a subsequent complaint visit to deliver findings on the above-mentioned allegation.
On 9/16/2021 at 9:38AM, Licensing Program Analyst (LPA) Thelma Razo arrived at the center and met with center staff Brooke Haslett. LPA toured the center with Ms. Haslett at 10:12AM to include 7 classrooms, and bathrooms. LPA interviewed 4 children and 4 staff. On 9/30/2021, LPA interviewed 4 parents over the phone.

During the facility tour on 9/16/2021 at 10:12AM, LPA observed postings to wear mask at the main entry way of the school and on each classroom (7 out of 7 classrooms). LPA observed 6 out of 52 children present were wearing masks indoor. Staff have indicated that children were encouraged to wear face coverings but most of the children refused or were uncomfortable wearing them and either take them off while in class or rip them off. However, there were no statement that indicate children were constantly reminded to wear mask as a precaution due to the pandemic or what other steps were done to encourage wearing of the mask indoor. One new staff was not even aware that children are required to wear a mask. Per Ms. Haslett, parents are required to bring mask for their children and to place a spare in their individual cubbies. However, during the tour on 9/16/2021, LPA observed 5 masks placed either on their cubbies or backpacks.

Out of fifty-two children, only 11 children brought their masks. There was no disclosure as to how the center handle the situation when children come without their masks.

This center was licensed to serve children age two to five years old. Per the California Department of Public Health (CDPH) "Guidance for the Use of Face Coverings" issued on 07/28/21, all persons, regardless of vaccination status are required to wear masks indoors, including K-12 schools, childcare and other youth settings because they are currently ineligible for vaccines and are therefore unvaccinated. This same guidance stated that, "In general, people do not need to wear masks when outdoors and that persons younger than two years old are exempt from wearing masks due to the risk of suffocation.” A copy of the guidance from CDPH was provided during this visit.

Based on LPA’s observation, interviews, and record review, the preponderance of the evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on the attached LIC9099-D.

The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.

Exit interview conducted with Ms. Haslett during which appeal rights were explained. A copy of the Appeal Rights and report provided.
