32 | Out of fifty-two children, only 11 children brought their masks. There was no disclosure as to how the center handle the situation when children come without their masks.
This center was licensed to serve children age two to five years old. Per the California Department of Public Health (CDPH) "Guidance for the Use of Face Coverings" issued on 07/28/21, all persons, regardless of vaccination status are required to wear masks indoors, including K-12 schools, childcare and other youth settings because they are currently ineligible for vaccines and are therefore unvaccinated. This same guidance stated that, "In general, people do not need to wear masks when outdoors and that persons younger than two years old are exempt from wearing masks due to the risk of suffocation.” A copy of the guidance from CDPH was provided during this visit.
Based on LPA’s observation, interviews, and record review, the preponderance of the evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on the attached LIC9099-D.
The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
