Licensing Program Analyst (LPA) Mary Silva conducted an unannounced site inspection to present the findings of the above complaint allegations. LPA met with licensee Rukshani Sunnadeniyage to whom the reason for the visit was explained. Licensee provided a tour of the facility. Present during the inspection was Licensee’s assistant, Licensee’s spouse and 7 children.

Allegation: Daycare child sustained injuries while in care

During the course of this investigation, LPA obtained a copy of the facility roster, photographs from the complainant and reviewed file for child #1. Interviews were also conducted with the Licensee, staff, parents, and other possible witnesses. Although the allegations may have happened or are valid there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. There were no disclosures made that corroborate with the alleged allegations. Page 1 of 2

Licensing Program Analyst (LPA) Mary Silva conducted an unannounced site inspection to present the findings of the above complaint allegations. Licensing staff met with licensee Rukshani Sunnadeniyage to whom the reason for the visit was explained. Licensee provided a tour of the facility. Present during the inspection was Licensee’s assistant, Licensee’s spouse and 7 children.

During the investigation Licensing Staff conducted interviews with licensee, staff, parents of daycare children and other possible witness. Licensing staff also obtained several documents related to the complaint allegation, including but not limited to a copy of the Facility Roster, and reviewed file for child #1.

During the course of the interviews conducted, a disclosure was made that corroborates with the above complaint allegation. Child #1 disclosed and illustrated how they were handled in a rough manner by a staff member.

Based on the preponderance of evidence standard has been met, therefore, the above allegations are found to be substantiated. California Code of Regulations (Title 22 Division & Chapter), are being cited on the attached deficiencies page LIC 9099-D.

Upon receipt of this report, the licensee shall post any licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the director will provide copies to the parents of the children in care for up to one year. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was explained and provided to the Director.

A notice of site visit was given and must remain posted for 30 days. Appeal Rights provided.

Based on interviews, the licensee did not comply with the section cited above as evidenced by a disclosure made during interviews conducted. Which poses an immediate health, safety, and personal rights of children in care.
