On 01/21/2021, Licensing Program Analyst (LPA) Candis Rodriguez conducted a complaint inspection via tele-visit. LPA spoke to Assistant Director (AD) Carissa Cederblom and took a census.
During the investigation, LPA interviewed AD, multiple staff members, parents, and children. LPA reviewed facility files, observed facility grounds, and obtained copies of children's registration information. Facility self reported a possible incident to Community Care Licensing on 12/10/2020.
During interview with Parent #1, it was revealed that Child #1 relayed an incident to Parent #1 which involved Child #2 inappropriately touching Child #1 in their private area. During interview with Child #2, LPA could not determine if incident occurred. LPA interviewed Child #3 and Child #4, but could not determine if either have witnessed inappropriate behavior. LPA attempted to interview multiple other children, but due to their age and verbal abilities LPA was not able to interview. During interview with Teacher #1, Teacher #1 stated observing children playing outside can be difficult at times, even while staying within ratio at all times. In interviews with Teacher #1, Teacher #2, Teacher #3, and Teacher #4, it was determined that no staff witnessed the alleged incident or any inappropriate behavior between children. During interview with Parent #2, Parent #2 stated Child #2 has never displayed this type of behavior and there is no history of physical or sexual abuse. Parent #2 stated they have not had any other issues at facility. Parent #2 stated they do not believe this incident occurred for these reasons.

During interview with AD, AD stated facility removed a playhouse from the outdoor play area which was identified by Child #1 to be the location of the alleged incident. LPA took photographs of the playhouse which had been moved to an inaccessible area to children. LPA observed the playhouse to have openings where a door or window would be placed, however from some angles it would be difficult to observe children if they were inside the playhouse. AD stated facility takes the allegation seriously and removed the playhouse for this reason. AD stated facility is also looking into installing a camera system indoors and outdoors to be able to review incidents in the future. AD stated immediately after the alleged incident was reported by Parent #1, AD notified the parent of Child #2 and moved Child #2 to a different classroom.

During interview with Parent #1, Parent #1 stated they were willing to bring Child #1 back to the facility as long as facility met certain requirements of Parent #1. During a subsequent complaint inspection visit on 01/14/2021, facility confirmed to LPA that Child #1 has returned to the facility.

Based on interviews conducted, investigation could not reveal that the allegation of Lack of supervision resulting in inappropriate interactions between day care children occurred. Therefore, although allegation above may have happened or is valid, there is not a preponderance of evidence to provide the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, no deficiency is cited. Exit interview conducted with Carissa Cederblom. Notice of Site Visit Form to be posted to parent's board and must remain posted for 30 days. LPA emailed the Notice of Site Visit, LIC 9099 and LIC 9099-C to AD and explained to AD to sign and return LIC 9099 and LIC 9099-C to Community Care Licensing.
