On 11/3/2022, Licensing Program Analyst (LPA), Hanson Leong, made an unannounced conclusionary complaint visit to the Mill Valley Preschool. The LPA was granted entry by the Director, Joseph Dummitt. The LPA explained the purpose of the visit to the director. Guardian, the department's system for conducting background checks, has confirmed that all the individuals listed on the facility’s roster have been granted permission to work or be present in a childcare facility. The LPA observed seven staff members supervising thirty-six preschool children inside the facility. Children's capacity and ratio requirements were observed to be in compliance.

The LPA conducted interviews with members of the staff and children as part of the investigation, as well as collecting and reviewing relevant documents. According to the conclusions reached by the LPA, there was sufficient amount of evidence to indicate that the two complaints that were filed regarding the facility were valid., which were that staff allowed child with high fever to stay in the classroom with other children and staff allow children with a fever to return without a 24 hour fever free period. ***See Page 2 for continuation***

Based on LPA interviews and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are founded to be substantiated.

Because the facility did not properly isolate a sick child, it will receive a Type-B violation for its failure to comply with the child care regulation.

The LPA has informed the director that a Plan of Correction would be provided for all Type B violations. This Plan of Correction will enable the director to correct the violation.



During the visit, the director corrected the deficiency by having a prepared statement and discussion with staff regarding the facility's failure to properly isolate a sick kid.

A Copy of Letter of Deficiency Citations was given to the licensee.

Appeal rights was discussed with the director

“The Notice of Site Visit” shall be posted for 30 days.

Failure to maintain postings as required, will result in an immediate $100 civil penalty.

The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.

The director will have a discussion with the staff on the state and company regulations requiring the immediate isolation of children who are ill while they are in the care of the staff, and they will prepare a statement that includes the topics that were discussed along with signatures.
