A complaint investigation inspection was conducted at the facility by Licensing Program Analyst (LPA), Amy Strother. It has been alleged that staff speaks to day care children in an inappropriate manner.

During today’s inspection, LPA met with Licensee/Center Director, Saprina Rodriguez (L1). LPA toured the facility, observing teacher/child interactions both in classrooms and outdoors. During today's inspection, staffing ratios were being met, a total of 40 children were being supervised by 7 staff. The facility was operating within the licensed capacity and ratio requirements. LPA interviewed L1, 3 Staff, Staff 1 – Staff 3 (S1-S3) and 5 children, Child 1 – Child 5 (C1-C5), interviews began at 11:03am. L1 denied the allegation stating that she has never heard staff speak in an inappropriate manner to any children. L1 stated that staff give children choices and talk about good choices and bad choices. L1 stated that when a child makes a bad choice, the child is asked to sit on a bench or chair, typically for 2 minutes and then after that calm down time, that staff speaks to the child.

Staff interviewed (S1-S3) all stated that they have never heard a staff speak to children in an inappropriate manner. Staff stated that they hear phrases such as “Please make good choices”, “Let’s be safe”, “Please sit down”, “Feet on the ground” or “Walking feet” to children when wanting to redirect behavior. All children interviewed (C1-C5), stated that they like their teachers and spoke about their teachers telling them that they need to make good choices. C2 stated that when they make a bad choice they are told to sit on the bench or chair or go to the office with Saprina. C3 stated that sometimes teachers say, “Go on time out.” C4 stated that when a teacher gets an angry face they say, “(Child’s name) try and do better.”, but sometimes a teacher will say “Can you please go pick up the toys”, and I do. During the tour of the facility LPA heard staff use phrases such as “Please keep your hands on your own lunch.”, “You need to do better, that’s why you’re in the chair.”, and “You are making good choices today, thank you.” Interviews conducted and observations made, corroborate that staff are consistent in the language used when speaking to children.

Based on LPA observations, staff interviews, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that an alleged violation occurred, therefore the allegation is UNSUBSTANTIATED.

There were no Title 22 deficiencies cited during today's inspection. This report was reviewed and discussed with the Licensee. Appeal Rights were provided.
