25 | On 2/23/22 Licensing Program Analyst (LPA) Joseph Pacheco arrived at the facility to conduct an unannounced Case Management Inspection. LPA toured the facility and a census was taken. An Unusual Incident was reported to Community Care Licensing on 2/22/22. On 2/17/22 Child #1 and Staff #1 were sitting outside on the playground bench when Child #1 started swinging their legs in excitement. Child #1’s legs made contact with Staff #1’s legs. Staff #1 then reached around the back of the child with their hand and pushed Child #1 forward. Child #1 did not sustain any injuries. Staff #2 witnessed the incident and reported it to Director, Stephanie Dunn. Facility immediately suspended and ultimately terminated Staff #1 and they are no longer employed at this facility.
Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights.
LPA Joseph Pacheco informed Director, Stephanie Dunn that this report dated 2/23/22 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Joseph Pacheco informed Director, Stephanie Dunn to provide a copy of this licensing report dated 2/23/22 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with the Director, Stephanie Dunn.
This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
