On 05/06/2021, Licensing Program Analyst (LPA) Robert Gutierrez met with Site Supervisor, Misty Mendoza, for an unannounced case management inspection. LPA toured the facility and a census was taken. An Unusual Incident Report was submitted to the Fresno Community Care Licensing Office (CCL) regarding an incident that occurred on 04/23/2021. This incident involved Child #1 hitting Child #2, with a plastic toy telephone. Staff #1 observed the incident take place and they hit Child #1 as a punishment for hitting Child #2. The purpose of today's inspection was to further investigate the aforementioned incident. Today, LPA interviewed facility staff and children who were present the day of the incident. According to staff, there were two teachers and approximately six children present. Based on interviews conducted, the incident transpired during free play when Child #1 hit Child #2 with a toy telephone. Staff #1 observed the incident take place and re-directed Child #1 to the block area. Staff #2 indicated she was in close proximity of the block area and observed Staff #1 with an open palm hit the top of the head of Child #1 and Child #1 began to cry. Staff #2 overhead Staff #1 say to Child #1 “Do you like to be hit like that?” while in the block area. After the incident took place, Staff #2 notified Site Supervisor. Site Supervisor spoke with Staff #1 about the incident and reports that Staff #1 stated they did not hit Child #1, but admitted to saying “Do you like to be hit like that?”. Due to the incident, Staff #1 was terminated the same day the incident occurred. Site Supervisor has coordinated a staff development day focused on personal rights of children in care. All staff are expected to attend this meeting scheduled on 05/14/2021. LPA verified Teacher - Child ratio was in place when the incident took occurred. Child #1 did not require medical treatment and remains in care. Parents of Child #1 were notified of the incident. Based on the information obtained, LPA determined the incident was handled appropriately and reporting requirements were met.

Per Chapter 1, Division 12, Title 22 of the California Code of Regulations no deficiencies are observed today. Site Visit Notice posted on the parent board. Exit interview was conducted with Site Supervisor, Misty Mendoza.
