Licensing Program Analyst (LPA)Teodoro Trujillo conducted an unannounced follow up complaint investigation and met with Director Loretta Ehrhart. Purpose of today's investigation: deliver investigation findings.

Based on interviews, observations, record reviews, and evidence gathered during the investigation process, the Department concludes that facility staff/teacher S1 spoke to children in an inappropriate manner and staff S2 did not ensure adequate supervision. The above allegations are thus found to be SUBSTANTIATED, meaning the allegation is valid because the preponderance of the evidence standard has been met.

A "Type A" deficiency is being cited on the attached LIC 9099-D. Exit interview conducted and report was reviewed with site Director Loretta Ehrhart. Appeal rights were also provided to Loretta Ehrhart prior to conclusion of today's inspection.

Type A Deficiencies were cited during today's visit. LPA Teodoro Trujillo informed site Director Loretta Ehrhart that this report dated 02/15/24 document(s) 2 (two) Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Teodoro Trujillo informed the site Director Loretta Ehrhart, to provide a copy of this licensing report dated 02/15/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the site Director Loretta Ehrhart.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Responsibility for Providing Care and Supervision
The licensee shall provide care and supervision as necessary to meet the children's needs.
No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

Based on evidence gathered, including record/document reviews, and interviews completed for the complaint investigation, it is concluded that although the allegations noted on this complaint may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur.
