On 09/10/2021, Licensing Program Analysts (LPAs) Tina Nguyen conducted a in person inspection to deliver the findings regarding the above complaint allegation. LPA Nguyen met with facility staff Adler Brittany; director Gary Overman came after. The Covid-19 Emergency Response questionnaires were asked. A toured the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 20 preschool, 4 staff members. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 07/07/21, the office received a complaint alleging adult to children ratio is not maintained during water activities and staff yells at day care children. Reporting Party (RP) disclosed Staff 6 (S6) supervises more than 10 children (approximate ages 5 -13) alone during swimming lesson. RP also disclosed S6 yells at children and parents in front of other parents.

During the investigation, LPA interviewed six staff members, two parents, three children, reviewed facility roster, and staff files.

On 07/13/2021, LPA Nguyen and Licensing Program manager (LPM) Ho conducted an initial 10-day inspection and toured the entire facility. During the tour, LPM Ho and LPA Nguyen observed one staff member supervised 6 children in the pool. Facility also provided LPA Nguyen’s Water Safety Education certificate of five staff members that supervise children during water activity.

During the staff interview, Staff 5 (S5) disclosed the facility offered private swimming lesson for the community. S5 confirmed the daycare children are not commingling with the non-daycare children during pool time. Daycare children are allowed to play in the pool every Monday and Friday from 12:30-2:30pm. There are three staff members supervising 10-12 children during water activity time. S5 also disclosed witnessing a non-daycare family was not happy with the swimming lesson. The family complained there were too many people swimming in the pool and requested a refund. S5 explained to the family that there were about 8 students with 2 staff members teaching the swimming lesson; the other children in the pool were sibling and their parents supervised them. S5 stated S6 has a loud voice and the family might be thinking S6 was yelling. All children and staff love S6. All interviewed staff stated the following: there are also 2 staff members supervising 6-8 children during swimming lesson. S6 is a good and friendly person. Never witnessed any staff member yells at children or parents.

All interviewed children stated they did not observe or witness any staff members yelled at children at the facility. Two interviewed children indicated there were about 10- 12 children during water activity. One interviewed child did not recall how many children present during water activity. All interviewed children stated there were always three staff members during water activities. All interviewed children stated they like all the teachers at the facility.

LPA Nguyen contacted five parents by phone and was able to interview two parents. All two interviewed parents stated they like the facility. Interviewed parents also stated they did not have any concern or issue with the facility.

Based on the information gathered from LPAs' interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged Adult to children ratio is not maintained during water activities and Staff yells at day care children did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
