The complainant alleged staff did not prevent day care child from engaging in inappropriate interactions with another child. According to the complainant, a day care child and another non daycare child was running and bumped heads at the playground.
On 2/25/22, LPA interviewed 1 staff member and the Director. The Director stated, on 2/17/22, he saw Child 1 (C1) sliding down the slide and was closed to the non-daycare child. The Director observed the parent of the non-day care child scolding C1. The Director walked closer to the playground and spoke to the parent and informed the parent will talk to C1. Staff 2 (S2) stated received a call from an anonymous person stating a daycare child and non-daycare child almost collided. There was no other disclosure as the anonymous person terminated the call. On 4/6/22, LPA interviewed 11 school age children. The 5 of the 11 children witnessed C1 almost bumped into the non-day care child, and 5 children stated the Director was near the playground area. There was no disclosure made from the 6 of the 11 children. On 4/12/22, LPA called 8 parents and interviewed 4 of the 8 parents. There were no disclosures made from the 4 parents interviewed. LPA did not receive a return call from the other 4 parents.
Based on interviews conducted, the complaint alleging staff did not prevent day care child from engaging in inappropriate interactions with another child is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
The complainant alleged staff engaged in a verbal altercation in the presence of day care children. The complainant stated after a call was made to the facility, the owner got out of the van and informed complainant he was the owner and engaged in verbal altercation in front of the children.
On 2/25/22, LPA interviewed 1 staff member and the Director. The Director stated shortly after C1 and the non-day-care child almost collided at the playground, the non-daycare parent started scolding C1. The Director approached the non-daycare parent and asked not to scold C1. There was no disclosure from S2. On 4/6/22, LPA interviewed 11 school age children, 5 of the 11 children indicated witnessed the non-daycare parent and Director exchange words, however the children deny a verbal altercation or inappropriate language from Director. There was no disclosure made from the 6 of the 11 children. |
