On 11/15/23, Investigator, Ge Sun, interviewed the complainant, who stated that C1 disclosed to complainant that staff touched inappropriately on the genital . Subsequently C1 disclosed to complainant, “I was pretending.” Complainant did not allow Sun to interview C1.
On 11/15/23, Investigator Sun, interviewed facility staff #1-#4 who all denied touching any children inappropriately nor have they witness any staff touch a child inappropriately. All staff stated that is the schools practice that all teachers and aides are allowed to take children to the bathroom, however only females employees assist children with toileting and wiping. Per the director and the staff, the younger children are changed on the diaper changing tables and the older children who are between the age of three to five, the female employees wipe children while they are standing.
On 02/14/2024, Investigator, Sun, interviewed three parents of preschool children who expressed no concerns of the facility.
On 02/14/2024, Investigator, Sun, interviewed medical personnel from Children’s Hospital Orange County. The staff did not express any concerns, based on medical exam and records. Investigator, Sun, obtained and reviewed the medical records from Children’s Hospital of Orange County, no medical concerns noted.
Investigator, Sun obtained and reviewed the Police Report from the Fountain Valley Police Department. The investigation was closed due to lack of evidence and parent of C1 not allowing detective to interview child.
Based on the investigation conducted by Investigation Branch (IB), there was insufficient evidence or corroborating information to support the allegation of inappropriate touching of a daycare child. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.
Exit interview was conducted with Director, Gabriel Hall. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. |
