During today's complaint inspection three children who attend the classroom in the sanctuary were interviewed. Children denied other activities in the sanctuary while they are in the sanctuary classroom except that currently children are practising for an upcoming play in the sanctuary.
Children are in the established sanctuary classroom Monday through Friday from 0900 AM to 11:30 AM. Ten children are enrolled in this class. A review of documents have verified the facility notified licensing to establish a classroom in the sanctuary as per regulation any changes in the plan of operation that affect services to children need to be reported to licensing. Licensing has requested a fire clearance. One fire clearance is in place for the sanctuary through the Church. The director provided a copy during today's complaint inspection.
During the exit interview the director and LPA discussed the regulation that In the licensing process for changes in the plan of operation when an approved fire clearance has been received the Department has completed a site visit to the child care center. This has not occurred. Therefore the director was informed that based on LPA's observations, interviews and record reviews the preponderance of evidence standard has been met, therefore, the allegation licensee is operating beyond the scope of their license is found substantiated. The following violation is being cited in accordance with California Code of Regulations, Title 22, Division 12, Section 101152(11)(B), on the attached LIC 809D.
Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the licensing office within 15 business days.
Notice of Site Visit was posted. The facility representative was informed that the 'Notice of Site Visit' must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00. The 'Notice of Site Visit' must be posted on or adjacent to the door.
