On 9/27/23 Licensing Program Analyst (LPA), Anna Chan conducted an unannounced complaint investigation visit to the facility to deliver the findings for the above allegations. This is a continuation of the investigation initiated on 09/01/23. Upon arrival, LPA met with Director Joy Lee. At 1:15pm the director guided LPA on a tour of the facility and a census was taken. There was a total of 72 children and 5 staff. Children were napping when LPA arrived at the facility.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 08/29/2023 alleging (1) Facility is not clean. The carpet is filthy and dirty, (2) Restrooms at facility are used by children and adults, (3) Staff intimidate the children and make them cry, (4) Staff are not fully qualified.

The reporting party (RP) stated that the carpet in room #13 is filthy. During the investigation on 09/01/23, LPA Chan interviewed the director regarding carpet cleaning. Based on the interview, the facility has a third-party cleaning service who goes to the facility twice a year. There is also janitors also cleans the facility every night. If there is a need to do a spot clean, a request for a spot clean will be given to the janitors and once it is cleaned, a log will be filled up. Based on record review of the communication between the facility and the third-party cleaner, a deep cleaning of the carpet on room #13 was done on March 22, 2023. Based on LPA’s observation, the blue carpet on room #13 is clean and in good condition. The carpet has no stains or dirt. Photos were taken during the investigation.

The RP alleged that children and adults use the same restroom while at chapel. During the investigation LPA Chan interviewed staff. On 09/15/23 LPA interviewed 4 staff members and all 4 staff have similar responses when asked about children’s use of restrooms during chapel time. Staff #1 (S1) stated children use hallway restrooms (restrooms near the classrooms) during chapel time. Staff #2 (S2) stated their class uses restroom in the classroom. The chapel restroom is for adults and elementary use only. Staff #3 (S3) stated their class uses restroom in the classroom because it is smaller. S3 stated kids are not allowed to use the chapel restrooms. Staff #4 (S4) stated the breaker will take the children who need to go to the bathroom to the classroom. “Before we do chapel time, we use the restrooms, so we are ready for chapel time.”

On 9/27/23 LPA interviewed 6 preschool children and all 6 children gave similar responses. The children where asked a true or false question and were able to answer correctly. Child #1 (C1) stated that C1 uses small potty next to the classrooms. Child #2 (C2) stated that C2 uses boy’s bathroom downstairs. Child #3 (C3) stated they use the bathroom downstairs at the girl’s bathroom. Child #4 (C4) stated they use the boy’s bathroom downstairs. Child #5 (C5) stated they use downstairs bathroom close to the office. Child #6 (C6) stated, when asked what restroom they use, “We always go where we always go” and points out the classroom side of the school. The chapel is located in a single story structure. The classrooms are located in a two story structure of the school.

The RP alleged that some of the staff are impatient with the children when the children are being potty trained. LPA Chan interviewed staff. On 09/15/23 LPA interviewed 4 staff and all 4 staff have similar responses when asked about staff intimidating children during potty time. S1 stated they always work with families. If they do potty training at home, we do it in school. S2 stated they do not force children to potty in the toilet especially if they are new to potty training. S2 stated they give the child time and don’t rush the child. S3 stated they ask the children if they need to go potty, if not, S3 stated they will just check back later with the child. They follow a routine in class and part of that schedule is going to the potty. S4 stated they try to encourage the child(ren), talk to the child(ren), ask if the child want a teacher to stand either near the door or by the potty chair. If there is a toy that they want to bring, the child can take it with them. S4 stated they try to make the child comfortable to go potty. If they are refusing to, S4 stated they don’t force them. S4 also stated some are a little scared, so teachers talk with the child to ease the child’s fear.

On 09/19/23 LPA attempted to do a phone interview with children’s authorized representatives and 2 out of 6 adults responded. Adult 1 (A1) stated the facility is “fantastic”. A1 also stated the facility is overall very good and very good in communication. Adult 2 (A2) stated facility does a great job in informing them every day with little notes. A2 also stated that the facility keeps a reminder when there is an upcoming activity to make sure the kids are prepared for the next day. Staff are friendly and the facility is very nice overall.

On 9/15/23 LPA attempted to interview 6 children in 2 different classrooms. Only 2 of 6 children are verbal. Child #3 (C3) stated he peed a little bit at home and in school. Child #6 (C6) stated he is wearing underwear and went potty.

During the investigation on 09/01/2023 and 09/15/2023 LPA reviewed a total of 10 staff records to verify that staff are fully qualified. Based on record reviews, it was determined the facility is operating within compliance of staff qualifications. The teachers meet the requirements of Title 22, Section 101216.1- Teacher Qualifications and Duties.

Based on observation, interviews conducted and record reviews, the complaint alleging (1) Facility is not clean. The carpet is filthy and dirty, (2) Restrooms at facility are used by children and adults, (3) Staff intimidate the children and make them cry, and (4) Staff are not fully qualified were found to be UNSUBSTANTIATED. Although the allegations may have happened or are valid, there is not enough preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

Exit interview conducted and report was reviewed with the director Joy Lee. Appeal Rights. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
