Licensing Program Analyst (LPA) Hawkins conducted a follow up investigation on October 14, 2021 at 1:50 PM regarding a complaint which was initiated on September 7, 2021 by LPA Hawkins. During today’s visit LPA provided the complaint findings to the director, Jennifer Davidson. At 2:00 PM LPA toured the center. Current census observed was 43 preschool children napping and 3 staff supervising in the chapel room. Total staff present at the facility was 8. A review of staff records on this date indicates that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On September 1, 2021 the Department received a complaint alleging that some staff are not wearing mask, day care children are not wearing face mask and staff do not enforce the mask wearing guidelines. During the investigation, LPA interviewed ten staff, ten parents, eight children and reviewed facility rosters, COVID 19 policy agreement, additional pertinent records, and staff/parent correspondences. ***continued on page 2***

Staff reported that the facility staff do not enforce any mask wearing policy for children, and children are not required to wear mask indoors at all. Staff added that they only encourage children to wear mask if their parents make a request for them to do so. All staff interviewed reported that parents are given an option regarding their child wearing a mask, and parents have an option to opt out without having a medical exemption or supporting documents supporting the no-mask. Staff reported that they are informed by either the front office or by parents that a child is exempt from the COVID-19 mask guidelines because a parent waiver was signed. Director reported that the understanding of the mask wearing policy for children was that it was highly recommended for children to wear indoors per the health department, and the facility supports the parent’s decision for their children either to wear a mask or not. Director added that some parents request that their child not wear a mask and the facility provides parents with a Face Covering Exemption Form to sign that do not require physician documentation supporting request. Director reported that she is an advocate for parents and children, and she honors the parent’s request. However, director reports that for parents that request for children to wear mask, staff encourages those children to wear the mask, and extra mask are available for any child that may need one.
Parents interviewed reported that they were informed by the facility that mask for children were optional and they were offered a face covering exemption form if they didn’t want their child to wear a face mask at school.

Some children interviewed reported that they do not wear a mask at school because they don’t want to, and their parents say they don’t need to. One child interviewed stated that he does wear a face mask because “the corona virus is still alive” and his mom wants him to. Another child reported that one of his friends wears a mask in the class, but he doesn’t.

During observations while conducting facility inspections on 9/7/21 and 10/1/21, LPA Hawkins observed extra mask at the facility and two children in room 103 wearing a mask, no children in room 104 wearing a mask, one child in room 102 , and 108 wearing a mask, and in Room 105, 106, and 110 children were observed during snack time when face mask are not required. The facility staff was not observed making any efforts to encourage the children to wear mask.

The Guidance for Childcare Industry Covid-19 update guidance: Childcare Programs and providers July 17, 2020 stated: children ages 2 years and older should wear face coverings, especially when indoors or when 6-foot physical distance from others cannot be maintained. New Guidance for the use of face coverings took effect on June 15, 2021 and superseded all prior face covering guidance. It stated: The following individuals are exempt from wearing masks at all times: persons younger than 2 years old, persons with medical conditions.

The guidance for COVID-19 mask requirements was sent to all the childcare providers by different Provider Information Notices (PINs) from the Department. The Orange County Childcare ordinance stated masks were required for children over 2 years old who attend the childcare facilities. LPA found that the facility had not enforced this requirement among children. Based on information obtained during interviews it was found the facility did not inform the parents of this requirement however recommended it.

Based on disclosures obtained during staff interviews, 10 out of 10 staff corroborated that the facility policy does not require children ages 2 an up to wear masks, it’s only an option parents have if they sign a face covering exemption form. Staff encourage it only if a parent request them to do so. All parents interviewed also disclosed that face mask for children are optional.

In regard to the allegation of some facility staff not wearing mask, director reported that all facility staff are aware of the mask requirement for all staff when indoors which directs staff to follow those guidelines. In addition, director reported that one staff has a medical condition that exempts the staff from mask wearing. However, an alternative face covering option, such as a face shield, has not been obtained/worn by staff yet. Some staff interviewed reported that they consistently wear their mask when indoors. Other staff interviewed reported that they wear their mask only sometimes when indoors, and the administration is not strict with the guidelines. Another staff reported that the director communicated to all staff during a meeting that as long as a mask is hanging around their ears and they can quickly put it on if a parent walks in that she is fine with that. Another staff reported that on occasions walk throughs are conducted to ensure staff are wearing mask. All staff reported that they require all adults to wear mask before entering a class/office.

During LPA’s facility visits on 9/7/21 and 10/1/21, LPA observed all staff indoors wearing a mask and there were “mask required/social distancing” posters on the exterior of the buildings. Parents reported that teachers are observed wearing masks only sometimes when in the classroom, and another parent reported that teachers are not wearing mask all the time when indoors. Parents reported that parents are required to wear mask when entering the class. Children interviewed reported that they see their teachers with mask on while in the class. Other children interviewed reported that their teachers only wear a mask sometimes in the class.

Based on LPA’s observations, disclosures, and documentation reviewed, the facility did not ensure the personal rights of persons in care to safe and healthful accommodations. In this facility some staff are not wearing mask and children were not required to wear face coverings while in the facility as required by the CA Dept. of Public Health Guidance on the use of face coverings on children issued June 18, 2020 and updated November 16, 2020 and an individual mask exception did not apply. The preponderance of evidence standard has been met, therefore the allegation of that children are not required to wear masks and some staff are not wearing mask are found to be substantiated. California Code of Regulations, Title 22, Division & Chapter 12, Section 101223(a)(2) are being cited on the attached LIC 9099D.

A copy of the County of Orange Health Officers Orders (Revised 06/17/21) was provided to the Director on today’s visit, PIN 21-18 CCLD was provided to the Director with the latest guidance on masks.

During the course of the complaint investigation it was disclosed by director, staff, and parents, that there were multiple positive COVID cases at the facility (from staff and children) during 2021. 3 out of 10 staff interviewed disclosed that they had tested positive for COVID while working at the facility during 2021, they had informed director and was quarantined per public health guidelines. Parents and staff reported that they had been contacted via email and or verbal in regard to potential/direct exposure and advised accordingly. According to records, parents/staff had been informed on at least five different occasions during 2021 via email (3/30/21, 8/11/21, 8/13/21, 8/19/21, 8/30/21) of positive COVID cases at the facility, and on at least two occasions the parents were informed that the whole school would close temporarily due to the exposure. In another instance room 108 and room 110 was closed as well. Director acknowledged that during the month of August 2021 there were at least 3 COVID positive cases reported to the facility and they followed health department guidelines for disinfecting and quarantining as required. Director added that due to extenuating circumstances the positive COVID cases (unusual incidents) were never reported to Community Care Licensing as required.
During the course of the investigation based on LPA’s interviews and records reviewed, LPA learned the facility did not report unusual incidents that occurred at the facility (positive COVID cases among staff and children) to Community Care Licensing as required. The following violation is being cited in accordance with California Code of Regulations, Title 22, Division 12, Section 101212(d)(1)(c), is being cited on the attached LIC 9099D.

Regarding the allegation of the facility staff not following sanitizing guidelines during an outbreak, the director reported that each class has an air purifier, high touch areas and toys are cleaned/disinfected daily. Initially the facility hired a cleaning company to provide extensive cleaning during the height of the pandemic, however now the cleaning/disinfecting is conducted in house. Director added that there are 2-4 assistants who assists with the daily extra cleaning of toys and high touch areas. Other staff interviewed reported that the facility has adequate soap/paper towel available to all, however, added that there are no consistent routines of disinfecting high touch common areas. Staff reported that there are custodians that come after hours to clean bathrooms, however bathrooms are not cleaned or disinfected throughout the day after multiple children use. Other staff reported that they were among the staff assigned to assist with disinfecting toys, however disinfecting of toys for several classes have not been done regularly. Staff reported that disinfecting is not a priority for the facility, only if they have time. Additional staff report that they take the initiative to ensure their class is disinfected throughout the day.

Regarding the allegation of facility staff not following social distancing during nap time, director reported children are positioned on cots head to toe and all classrooms nap together in the nap room. Director added that there is space between cots for staff to pass or to rub a child’s back the exact amount of space specifically is unknown. The facility has a policy that staff are not allowed to congregate in classrooms. Additional staff reported that at the beginning of COVID children napped in small cohorts, they have returned to classes napping in one room with cots in close proximity of each other. Some staff describe the nap room as very cramped.

Some parents interviewed reported that the staff is kind, very attentive, communicates well with parents. One parent reported that their child was not adequately cared for and not properly cleaned after having bathroom accidents. Some parents interviewed reported that the facility is a clean environment, and they are very satisfied with the care and supervision provided to their children. One parent interviewed explained their concerns regarding the number of children (approximately 50-60) napping together in one room, and they didn’t believe it was safe during COVID. ***continued on page 3***

The Department has investigated the complaint alleging staff are not following sanitizing guidelines during an outbreak, and facility staff are not following social distancing during nap time. Based on conflicting statements received during the investigation, we have found that the complaint was unsubstantiated. While the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Technical assistance was provided during todays inspection in the form of an advisory note.

Exit interview was conducted with director Jennifer Davidson. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights explained. A copy of their appeal rights (LIC 9058) was given and signatures on this form acknowledges receipt of these rights. All appeals must be in writing and received by the licensing office within 15 business days. The first level appeal is to regional manager; address is above on the report.
