Licensing Program Analysts (LPA) Odom conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 08/08/2022. Upon arrival LPA met with Site Director, Nancy Vasquez, to deliver complaint findings. Director guided LPA on a tour of the facility. LPA observed a total of 26 preschool age children with 4 staff.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 08/03/22. Reporting Party (RP) alleged staff withhold snacks from child(ren). RP stated, Staff #1 (S1) told a child that they won’t get a snack if they oversleep.

During the investigation LPA Odom interviewed director, 2 staff members, 3 children and 4 parents. LPA conducted a facility inspection, reviewed the children’s roster, personnel report, and childcare daily schedule.

During the investigation, Director (S3) was interviewed on 08/08/22. S3 stated, the preschool provides breakfast, lunch and afternoon snacks to all the children in care. If a child does oversleep a snack is still provided to the child by leaving it on the table until the child wakes up. At around 2:15pm staff will turn on the lights, play music and tell the children it’s clean up time. S3 disclosed they currently do not have any children that oversleep in S1’s classroom. S3 stated they have never observed or heard S1 yell or tell any child that they cannot have a snack if they oversleep. S3 stated the facility discipline policy is for the staff to talk with the child and/or redirect the child.

During the investigation, 2 staff members were interviewed on 08/08/22 and 09/01/22. S1 stated sometimes there will be a child that oversleeps, if the child is still sleeping after wake-up time S1 will let them sleep until after snack time and gently try to wake up the child to continue with the daily schedule. Even if the child oversleeps a snack will be provided. S1 stated they have never told a child they cannot have a snack if they oversleep. Staff #2 (S2) stated the children are usually awake by snack time and children have never been denied snacks even if they oversleep.

On 08/08/22 LPA Odom attempted to interview 4 children, however only 3 children qualified for interviews. All the children interviewed disclosed they get snacks after nap time even if their friend sleeps longer. None of the children disclosed that staff yell or are mean to them.

On 9/22/22 LPA Odom attempted to interview 10 parents, however only 4 parents were available for interviews. None of the parents disclosed any concern with the childcare facility or staff. All of the parents are satisfied with the childcare. Parent #2 stated they are very happy with the staff and how well they work with their child.

Based on LPA’s facility inspection, observations, interviews conducted with director, 2 staff, 3 children, 4 parents and records reviewed it was determined there was insufficient evidence that S1 withholds snacks from children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated.

Exit interview was conducted with Site Director Nancy Vasquez. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
